  2. Agenda for this morning • Duties of Office • County Uniform Highway Law (CUHL) • County Road Acceptance and Classification • Purchasing • Interaction with other county officials

  3. Duties of the Chief Administrative Officer (CAO) of the County Highway Dept. • Upon election, take an oath of office as provided in Article 1, Section 1 of State Constitution and T.C.A. §§ 8-18-111 & 54-7-108. • Post an official bond of a minimum of $100,000 per T.C.A. § 54-7-108. • In CUHL counties, the CAO is responsible for hiring, overseeing and terminating employment of county highway employees. • Approves personnel policies and work times.

  4. Road Employees… • Take care to have any personnel policies (and changes) reviewed by the county attorney before implementing. • Be sure that policies are in compliance with FLSA, state and federal anti-discrimination laws and other applicable laws.

  5. Supervise the Work • CAO is generally responsible for the use & control of all machinery, tools, supplies & material used in the county for construction, repair & maintenance of county roads and bridges. T.C.A. § 54-7-112.

  6. Remove the Obstructions • CUHL authorizes the CAO to remove or cause to be removed any gate, fence or other obstruction from the county roads, bridges and right-of-ways. T.C.A. § 54-7-201.

  7. Annual Work Program • In CUHL counties, CAO prepares and submits an annual work program to CLB and TDOT. • In counties with popularly elected road boards, it appears that the CUHL places prioritizing the program with the board. T.C.A. § 54-7-109.

  8. Other Duties… • Under the CUHL, perform complete inventory within 60 days of taking office and file this report with the CLB. File an amended inventory every subsequent year by September 1st. T.C.A § 54-7-112. • Plainly mark all county highway equipment. • County mayor is obligated to examine these inventories for compliance and may withhold funds until compliance is achieved.

  9. Duties of CAO in Counties with a Private Act • According to AG Opinion 88-01, general control and authority over the county road system is vested in the CAO unless the “elected road commissioners” are popularly elected. • If under private act, get a copy of the act and review. If you have any questions about what county official is responsible for a particular duty, consult your county attorney or contact CTAS.

  10. County Road List • CLB is charged with classifying public roads. The CAO is required to submit a detailed listing of all county roads to the CLB. T.C.A § 54-10-103. • CAO should present the county road list to the CLB with additions/ deletions at CLB January meeting.

  11. Eight Items the Road List Should Include: • Type of road (county or state-aid) • State-aid road description (only for counties in the state-aid road system) • Local name of road • Beginning and end of road (reference to geographical features)

  12. Eight Items the Road List Should Include (cont.) • Miles (length to nearest 1/10 of a mile) • Class (classify according to width as set out by T.C.A. §§ 54-10-103 & 54-10-104 7. Right of way width (in feet) 8. Roadbed width (in feet)

  13. Acceptance and Deletion from County Road List • Can be very confusing as procedures may vary from county to county. We recommend consulting the county attorney to review local procedures before accepting or deleting any county roads. • AG has opined (Op No. U 89-10) that the CAO or elected road board in counties under the CUHL has the authority to open and/or close county roads. HOWEVER, this is only the first step, as CLB must approve additions/deletions to road list per T.C.A. § 54-10-103.

  14. Alternative Procedure for Closing a County Road • Local option public law enacted in 1995 and codified in T.C.A. § 54-10-216. • Enacted by 2/3 vote of CLB. • Law provides a specific process to close road: Application to close road submitted to CAO, public notice to interested parties, CAO makes recommendation to regional planning commission, planning commission gives appropriate notice, planning commission recommends to CLB, then CLB votes to close road.

  15. Purchasing • CUHL does not specify who is the county purchasing agent for the highway department is; not intended to repeal existing statutes on this matter T.C.A. § 54-7-113(c)(3). • Need to ascertain what particular purchasing law your county operates under (general law, 1957, 1981, private act).

  16. Purchasing • Regardless, purchases over $10,000 generally have to be publically bid. • Exceptions include repair of heavy equipment with limited available repair facilities and emergency purchases.

  17. Remember! • Do not issue separate PO’s and ask for multiple invoices on the same piece of equipment to circumvent bid limits (the auditors know that new vehicles typically come with engines already in them and without a professional service fee for engine installation)

  18. Remember! • Failure to plan by management for routine expenditures does NOT create an emergency purchasing situation under state purchasing laws. There is no such thing as “emergency, no-bid, painting of the inside walls of county buildings”.

  19. NEVER FORGET • NEVER DO WORK ON, OR USE, COUNTY EQUIPMENT OR SUPPLIES ON PRIVATE PROPERTY! Terminate any employee that violates this law. (T.C.A § 54-7-202). • Do not drop “excess” gravel in church parking lots or individuals’ driveways. • Private bridges touching county roads are just that…and the “last guy” did not fix it despite what the homeowner says. • Reimbursement work for other government agencies: Have it in writing and be sure it is approved first by the CLB. T.C.A. § 54-7-202(d)(2).

  20. Interactions with Other County Officials • Depending on the accounting/budgeting law your county is under, coordinate with the county mayor/finance director as applicable. • Prepare and submit an annual budget and any budget amendments to the CLB timely. • Remember to verify that the five-year average is met for local effort. Notify mayor/finance director if it appears it will not be met. • Work with mayor/finance director to maintain capital asset, infrastructure & accrued leave (if any) reporting for GASB 34 & 51 requirements. • Submit changes to county road list timely to CLB.

  21. Advice From Your Counterparts for Your First Year in Office • Get involved in programs that bring in outside funding (USDA NRCS). • Consider a written (and approved by CLB) inter-local agreement with a neighboring county to borrow equipment that you don’t have. • Keep the road board (if you have one) and the CLB in the loop as much as possible. • Call TDOT, CTAS, TCHOA, TDEC and other CAOs if you have questions…we all want you to succeed! Remember, it is easier to stay on the road then pull it out of the ditch.

  22. Advice From Your Counterparts for Your First Year in Office • When you do your first inventory, if you have a lot of old equipment that is no longer in use, get it declared surplus and sell it on Gov Deals. Its not doing anything sitting out rusting out in the yard. • Understand and watch your budget. If you run the highway department like a broke farm, you will do OK.

  23. Advice From Your Counterparts for Your First Year in Office • If you please everybody, you are not doing your job! • Remember, when you take office, it’s your responsibility. If there is equipment missing from the inventory when you get there then let the road board, county audit, county mayor and if needed, the district attorney, know about it sooner instead of later.
