California Child Passenger Safety (CPS) Laws • Vehicle Code (VC) 27360 series: http://www.dmv.ca.gov/pubs/vctop/vc/tocd12c5a3_3.htm • 27360 – child restraint system from 0 to 8 years in the rear seat • Exemption for child restraint system of 4’9”, (VC 27363) • Exemption for rear seat position if all the seating positions are filled with other children seven years of age or under. (VC 27363) • No delineation of 1 years old and 20 lbs. for rear-facing or not in front seat. • 27360.5 – child restraint system or seat belt from 8 years to 16 years to be properly restrained • With definition of proper restraint listed under VC 27315 http://dmv.ca.gov/pubs/vctop/d12/vc27315.htm • 15620 – prohibits leaving unattended child under age seven in a vehicle where a significant risk to the child’s health and safety is present or when keys are left in the ignition or the car is running

California Child Passenger Safety (CPS) Laws AB 1452 (Hill, Chaptered 185, Statutes of 2012) http://www.leginfo.ca.gov/pub/11-12/bill/asm/ab_1451-1500/ab_1452_bill_20120827_chaptered.pdf • Section 27363.5 of the Vehicle Code is amended to read: • (a) A public or private hospital, clinic, or birthing center shall, at the time of the discharge of a child, provide to and discuss with the parents or the person to whom the child is released, if the child is under eight years • of age, information on the current law requiring child passenger restraint systems, safety belts, and the transportation of children in rear seats. • (b) A public or private hospital, clinic, or birthing center shall also provide to and discuss with the parent or person to whom the child is released, if the child is under eight years of age, contact information to direct the person • to an Internet Web site or other contact that could provide, at no cost or low cost, information and assistance relating to child passenger restraint system requirements, installation, and inspection. Pursuant to this subdivision, the hospital, clinic, or birthing center does not have any additional obligation to provide patients with any assistance relating to child passenger restraint systems, other than providing the contact information as set forth in this subdivision. This contact information may include the following: • (1) Call 1-866-SEAT-CHECK or visit www.seatcheck.org to find a nearby location. • (2) The telephone number of the local office of the Department of the California Highway Patrol. • (3) The Internet Web site for the National Highway Traffic Safety Administration’s Child Safety Seat Inspection Station Locator. • (4) The Internet Web site for the State Department of Public Health’s child passenger restraint system safety inspection locator. • (c) A public or private hospital, clinic, or birthing center shall not be responsible for the failure of the parent or person to whom the child is released to properly transport the child.
