  2. PRISON RAPE ELIMINATION ACT (PREA) • PREA was established in 2003 to address the problem of sexual abuse and sexual harassment of persons in the custody of U.S. correctional agencies. Major provisions of PREA include the development of standards for detection, prevention, reduction and punishment of prison/jail rapes. The Act applies to all public and private institutions that house adult or juvenile offenders and is also relevant to community based agencies. • The John E. Polk Correctional Facility has adopted a zero tolerance on issues pertaining to sexual abuse and sexual harassment involving inmates and is working continuously to implement new policies, training requirements for staff and inmates, and developing standards for detection, prevention, reduction and punishment of rape.

  3. PRISON RAPE ELIMINATION ACT (PREA) Definitions: • Unfounded: The allegation is false or not factual • Substantiated: The allegation is supported by sufficient factual evidence • Unsubstantiated: There is insufficient factual evidence either to prove or disprove the allegations.

PREA Annual Report 2013-2014 Analysis/Corrective Action There were no PREA Standards requirements to analyze efforts in 2011, due to final PREA standards/requirements not being finalized until August 2012. As a result there is no corrective action in 2011 with which to compare in 2012. However, since 2006, basic PREA Standards were implemented by the John E. Polk Correctional Facility . Although there was not a full awareness of the impact of PREA other than knowing that signs were erected in the facility, immediate reporting was necessary and issues were handled with internal administrative investigations, many of the components still remained unimplemented. While many of the standards were adhered too in practice or procedure they were not fully implemented in policy. The facility recognized the importance of becoming compliant with PREA standards to increase the safety of inmates while incarcerated at the JEPCF and to abide for the continued confinement of Federal Inmates.

PREA Annual Report 2013-2014 • Analysis: Basic staff and volunteer training was conducted from 2006 to 2012. • Corrective Action: PREA training was expanded to Medical and Mental Health practioners, County Probation • Analysis: A PREA Coordinator was not implemented in 2012. • Corrective Action: A PREA Manager and Coordinator was implemented in 2013. • Analysis:Contracts - The contract renewals did not include the provision to adopt the PREA standards • Corrective Action: All new or renewed contracts were updated to include the adoption of PREA standards

PREA Annual Report 2013-2014 • Analysis: No unannounced rounds/checks were implemented in the facility in 2012/2013. • Corrective Action: Log sheets were created in Ellis to reflect unannounced rounds by Lieutenants and Captains. • Analysis: No Standardized screening instrument was in place. • Corrective Action: Screening Instrument was implemented in October 2013.

PREA Annual Report 2013-2014 • Analysis: No Victim Advocate services were initiated in 2013 for PREA compliance. • Corrective Action: Contacted Brevard Seminole Sexual Assault Victim Services (SAVS) to enter into Memorandum of Agreement to provide services per PREA standards in 2014. • Analysis: No PREA Committee was implemented in 2012/13 for review of Administrative PREA complaints. • Corrective Action: PREA Committee implemented in 2013 to review cases and address issues that would need corrective action. • Analysis: No inmate training and notification to inmates about PREA was initiated in 2013. • Corrective Action: Posters were purchased, JDI video played for inmates at first appearance and in intake area, PREA information posted on flyers, PREA information is included in inmate handbook, PREA information is posted on the Sheriff’s Office website and inmates are advised upon intake about PREA and how to protect themselves and report complaints.

PREA Annual Report 2013-2014 • Analysis: No third party reporting mechanism available in 2013. • Corrective Action: Entered into MOU with SAO to provide a separate entity to report Sexual Abuse. • Analysis: No Rape Crisis line available to inmates. • Corrective Action: Entered into MOU with SAVS to answer installed lines in the housing units. • Analysis: No data analysis or website information available to the public. • Corrective Action: PREA Information placed on the agency website along with a third party and anonymous web reporting form.

PREA Annual Report 2013-2014 • Review data collected and aggregated in order to assess and improve the effectiveness of our sexual abuse prevention, detection, and response policies, practices and training, including by: • 1. Identifying problem areas • 2. Taking corrective action on an ongoing basis • 3. Preparing an annual report of findings and corrective actions for the facility

  10. PREA Annual Report 2013-2014 115.88 (C) The agency’s report shall be approved by the agency head and made readily available to the public through its website or, if it does not have one, through other means.

PREA Annual Report 2013-2014 • Recommendations • After separate female inmate incident reviews it was recommended to move minimum and medium custody female inmates to Direct Supervision Housing Unit. This reduced the incidents of consensual relationships by removing the older style dorm room cell which does not have direct supervision by sight or camera.
