  3. Overview • Provides Guidance to agencies regarding entering into ESPCs and UESCs for energy efficiency and new renewable power generation. • Memo clarifies the circumstances under which ESPCs and UESCs may be scored on an annual basis.

  4. Onsite Energy Generation • To qualify for the scoring on an annual basis covered by M-21-12, in addition to complying with all other requirements: • Government must retain title to the installed capital goods at the conclusion of the contract • ESPC and UESC may not be used to build merchant-scale power generating facilities on Federal land.

  5. Off-Site Energy Generation • To qualify for the scoring on an annual basis covered by M-21-12: • ESPC and UESC authority may not be used for the long-term purchase of off-site new renewable generation.
