For the Department of Buildings (DoB) in New York City, keeping the public safe is of the utmost importance, and with so many towering structures in the sprawling city, ensuring that they all meet safety regulations is a mammoth task. But what happens if a building doesn’t meet the regulations and laws put in place by the DoB? Building code violations For any building found not to be in full compliance with DoB laws, a violation will be issued, and depending on its severity, this may be used to instigate criminal proceedings for the buildings owner. Those violations that don’t carry immediate fines or penalties, are often left untended to, posing a further threat to public safety.

  3. What happens if you don’t address a reported building’s violation? Should a building owner choose not to address a violation they have been issued with, that violation will continue to show up in routine title searches, and will stop any construction plans or the selling of the building, until the violations have been resolved in accordance with DoB guidelines. If a building you own in NYC has been reported for a public safety violation, you must seek corrective action, immediately.

  4. What are some of the most common violations served by the DoB? While a variety of violation notices can be served, from structural to environmental infractions, below are 5 of the most common: 1. Not providing adequate heat and hot water If the indoor temperature isn’t at 68 degrees when it’s below 55 degrees outside, or the indoor temperature isn’t at 55 degrees when it’s below 40 degrees outside at night, a violation may be served.

  5. The hot water supply for a building must also be at a minimum temperature of 120 degrees, all of the time. 2. Not installing working carbon monoxide and smoke detectors For long-term tenant’s of a residential or commercial space, at least one carbon monoxide and one smoke detector must be provided by the building owner, although it’s the responsibility of the tenant to maintain them appropriately. 3. Locks on doors and windows requiring a key to open them In an emergency, every second counts, and if a tenant has to spend some of that precious time searching for a key in order to open a window and climb out, it could be the difference between life and death.

Mold growth and a presence of pests While it is the responsibility of tenants to maintain a certain level of cleanliness inside the space they’re living or working in, should any conditions that have caused the excess growth of mold or the presence of pests been overlooked by the building owner, they may be issued with a violation. 5. A lack of accessibility for all For architects and builders, when designing and constructing buildings in NYC, they must adhere to Title III of the Americans Disabilities Act (ADA), and ensure that a building has appropriate accessibility for everyone.
