  1. Answering Your NYC Building Violation Questions

  2. Building violations in New York City are no joke, but armed with the right information, and by seeking help from an experienced construction firm who can successfully and legally rectify the issues, you can tackle them with confidence and minimize penalties. Read on for answers to some of the more common questions surrounding NYC building violations: Q. I need to look at the violation I’ve received and my court date; how do I do that? A. By visiting the department of buildings website and entering your property’s information in the panel on the left-hand side.

  3. Q. If I can’t attend court on the scheduled hearing date, what should I do? A. If you fail to show up to a scheduled hearing, you’ll default on the violation. In some instances, a specialist violation removal firm can represent you. Q. Notices from the ECB state that I owe money for a violation I know nothing about, what should I do? A. If you reach out to a company who deal with violation removals, they may be able to get you a new court date before a maximum penalty is imposed. If it’s too late, however, they may still be able to reduce the fine.

  4. Q. Can I avoid a penalty for an ECB violation? A. if your violation notice has a ‘cure date’, then you may be able to correct the violation before that date and avoid paying a fine to the court. Q. What is a stipulation? A. This is an agreement in which you plead guilty to the violation, and is between you and the Department of Buildings. You’re given extra time to correct the violation and a reduced penalty.

  5. Q. The violation still shows as ‘open’ even though I’ve paid it? A. The violation must not only be paid for, but corrected; file a Certificate of Correction for approval from the DOB. Q. My building has open violations, is this cause for concern? A. Yes. Until you resolve the violation, you’ll continue to receive penalties. Q. What is a vacate order? A. This order from the DOB, instructs you to vacate the part of the premises deemed unsafe for habitation, and it’s important that you don’t remove the order from your property, or you will face a stiff penalty.

  6. Q. I’ve been issued with a ‘stop work order’; what is it? A. Issued by the DOB when, following an inspection, hazardous or unsafe work conditions are discovered, a ‘stop work order’ is designed to protect workers, tenants and the public from unsafe work, or work carried out in the absence of a permit. Again, it’s important that you don’t remove the notice, and don’t violate it in any way. Q. Do I need to repair my sidewalk after receiving a violation? A. You’ll need to make the repairs to the sidewalk in question, and this type of violation typically includes cracks or uneven concrete that can present a tripping hazard. Find a good construction company well versed in violation removals, and get the problem solved fast.
