    20. November 2004 20 Magistrate Appeals {Generally} Failure of the appellant to appear justifies dismissal of the appeal and the judgment of the magistrate is affirmed. If no motion contesting jurisdiction or venue is made prior to the small claims trial date, it is waived. Check carefully to see if a jury trial was requested. If claim for relief is unclear, you can always order re-pleading. [Right to conduct discovery or replead is not allowed without permission of Court.] You will have to draft the judgment yourself. Record a notation as to the responsible attorney to prepare proposed order, submit it to opposing counsel, and then submit it to you for signature. After receiving jury verdict, remember to actually enter judgment in accordance with the verdict and direct the prevailing party to prepare the judgment.
