IPPC Directive • Status of IPPC Transposition • Transposition is nearing completion, currently reaching 95%. • It is expected to be completed by the end of 2009. • Almost all provisions have been transposed in the 2005 Law on the Environment as amended in 2007. • In addition a 2005 Decree for determining the Activities of Installations requiring an Integrated Environmental Permit, and a 2006 Rulebook on the Procedure of Issuing an Integrated Environmental Permit are relevant transposition measures. • Transposition will be completed to transpose Annexes II, III and IV through the adoption of secondary legislation by the end of 2009. • Stakeholder involvement • MoEPP, LSG, NGO, other ministries, industry • Institutional structures for IPPC law implementation • The MoEPP is the Competent Authority for issuing integrated permits. • The State Environmental Inspectorate is responsible for supervision of the implementation of IPPC permits. • Inventory of IPPC Installations • 137 installations falling under the IPPC permitting obligation. • the number is not considered definite and updates will be done on the basis of site visits. • A clear picture is expected in 2009, once all installations have submitted applications for permits.

Timetable for IPPC Permitting - 2006to 2007 : Metal, Energy, Poultries • 2007 to 2008 : Mineral, Stationary Asphalt Bases, Chemical • 2008 to 2009 : Others, Waste • Best Available Techniques • In the framework of a Cards 2004 project ("Strengthening the Environmental Management") guidelines on BATS have been produced for some sectors (Non-Ferrous Metals Processing, Iron and Steel, Self-monitoring, Cement Clinker Production, Waste Waters and Waste Gases Treatment, Production of Ceramics, Intensive Poultry Farming and Monitoring). • A Commission for BAT will be established by the MOEPP in order to define best available techniques. • Competencies and skills for issuing integrated permits • SectorofIndustrial Pollution and Control, IPPC Department, 9(+2) permit writers • 87 applications have been submitted so far, 2 permits have been issued (existing installations)

Large Combustion Plants Directive • Transposition of LCP Directive • at an early stage while the date for full transposition is projected as the end of 2009. • A few provisions are currently transposed through the Law on Ambient Air Quality of 2004, the 2005 Law on Environment as amended in 2007 and the Rulebook on the Procedure Issuing Integrated Permits of 2006. These concern definitions, discharge conditions, cross-border cooperation and provision of self-monitoring information. • Comprehensive transposition will occur through the adoption of further primary and secondary legislation, including a Rulebook on Emission Limit Values. The adoption of all remaining provisions is scheduled for end of 2009. • Inventory of LCP installations • 7 large combustion plants • 2 LCPs with thermal input greater than 300 MW. • Only one new LCP was granted a permit until now. • The LCPs with rated thermal input above 50 MW are subject to A - IPPC Permit or Adjustment with Adjustment Plans Permits

Seveso II Directive • Transposition of Seveso II Directive • transposition is already reaching 63 % • to the end of 2008 = 2 sub legislation acts • Inventory of Seveso II installations • 15 Sevesso II instalation • Competent authorities/Tasks • MoEPP, LSGU, Protection and Rescue Directorate • Accident prevention policies • Safety reports

  7. Waste Landfill Directive Transposition of Waste Landfill Directive Transposition has advanced significantly since the last monitoring period. The Law on Waste Management as amended in 2007 transposes many of the provisions of the Landfill Directive (from 43% in 2007- to 87% to the end of 2008) The transposition status was further strengthened by the adoption of the 2008 Rulebook on the criteria for the acceptance of waste in landfills. The Rulebook for the monitoring of the work of landfills and Rulebook on the form and contents of the request for licensing of landfill operator both of 2007 are also relevant for the transposition of this directive. Additional secondary legislation will be adopted to complete transposition to the end of 2008. Number of landfills 44 municipal landfill sites and 16 industrial landfill sites Landfill classification Landfills have been classified in accordance to the waste as landfills for communal, hazardous, non-hazardous and inert waste. Strategy for reduction of BMW to landfills Target for reduction of BMW to landfills A national strategy for the reduction of biodegradable waste will be prepared. It was anticipated under the previous monitoring period that the strategy will be under implementation until 2009 but currently the deadline was moved to 2015.

Criteria for waste to be accepted to landfills • According to the 2008 rulebook mentioned above for every accepted waste the operator of the landfill has to fulfil identification form and to check visually whether the waste is comply with the content stipulated in the forms. When there is doubt that the waste is not in compliance with waste form it can take samples to confirm the content of waste. If the waste is not in compliance with the form it should notify the Administration of Environment. • Landfill permits requisites • IPPC Permits will also contain control and monitoring requirements. A legal framework for closure and aftercare procedures has been established.

  9. Waste Incineration Directive • Transposition of Waste Incineration Directive • Slightly progress since the last monitoring period. (from 33% to 36%). • The Law on Waste Management as amended in 2007 is the main transposing act together with the Law on Environment and the Law of Ambient air quality transposing a bit more then 1/3 of the provisions of the directive. • Number of incineration and co-incineration plants : 0 • No of permits issued : 0 • Categories of waste co-incinerated : no • Emission Limit Values : not established
