RTI Act 2005 Objectives - To empower the citizens, promote transparency and accountability in the working of the Government, contain corruption, and make our democracy work for the people in real sense. - Making the citizens informed about the activities of the Government. Rights - A citizen has a right to seek information from a public authority which is held by the public authority or which is held under its control. Contd

RTI Act 2005: Rights (Contd) - Rights include inspection of work, documents and records, taking notes, extracts or certified copies of documents or records; and taking certified samples of material held by the public authority or held under the control of the public authority. - A citizen has a right to obtain information from a public authority in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through print-outs provided such information is already stored in a computer. - The Act gives the right to information only to the citizens of India. It does not make provision for giving information to Corporations, Associations, Companies etc. which are legal entities/persons, but not citizens.

  5. RTI Act 2005: PIO Public Information officer(PIO) -Public authorities have designated some of its officers as Public Information Officer. They are responsible to give information to a person who seeks information under the RTI Act. Assistant Public Information Officer -These are the officers at sub-divisional level to whom a person can give his RTI application. These officers send the application to the Public Information Officer of the public authority or the concerned appellate authority. -An Assistant Public Information Officer is not responsible to supply the information. -The Assistant Public Information Officers appointed by the Department of Posts in various post offices are working as Assistant Public Information Officers for all the public authorities under the Government of India

RTI Act 2005: CIC - The Central Information Commission(CIC) decides the appeals and complaints and conveys its decision to the complainant and Public Information Officer. -The Commission may decide an appeal/complaint after hearing the parties to the appeal/complaint or by inspection of documents produced by the appellant/ complainant and Public Information Officer.

  7. RTI Act 2005 :Format - There is no prescribed format of application for seeking information. - Application can be made on plain paper and should have: i. Applicant’s name ii. Complete postal address iii. Email id iv. Contact number v. Subject matter

RTI Act 2005: Fees -Person who desires to seek some information from a public authority is required to send, along with the application, a demand draft or a banker’s cheque or an Indian Postal Order of Rs. 10/- payable to the Accounts Officer of the public authority as fee for information. - Actual charge or cost price of a copy in larger size paper - Rupees fifty (Rs. 50/-) per diskette or floppy - First hour for inspection of records, no fee. But fee of rupees five (Rs. 5/-) shall be charged for each subsequent hour. - Nil for BPL categories.

RTI Act 2005: Public Authorities • All public authorities to publish sixteen categories of information: Some important of them are:- - The particulars of its organisation, functions and duties. - The powers and duties of its officers and employees. -The procedure followed in the decision making process, including channels of supervision and accountability. -The rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions. - A statement of the categories of documents that are held by it or under its control. -Directory of its officers and employees. RTI Act 2005: Public Authorities(Contd) - The monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations. - The budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made. - Particulars of recipients of concessions, permits or authorisations granted by it. -The particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use. - The names, designations and other particulars of the Public Information Officers - It is mandatory to provide reasons for decisions taken by the Public Authorities to the affected persons.

  11. RTI Act 2005 Time period 1. Information to an applicant shall be supplied within 30 days from the date receipt. 2. If information sought concerns the life or liberty of a person, it shall be supplied within 48 hours. Appeals • If an applicant is not supplied information within the prescribed time of thirty days or 48 hours, he may prefer an appeal to the first appellate authority, who is one stage higher in cadre to the PIO. • Appeal should be filed within a period of thirty days from the date on which the limit of 30 days of supply of information has expired. • The appellate authority dispose the appeal within a period of thirty days or in exceptional cases within 45 days of the receipt of the appeal. RTI Act 2005: Appeals(Contd ) • If the first appellate authority fails to pass an order on the appeal within the prescribed period or if the appellant is not satisfied with the order of the first appellate authority, he/she may prefer a second appeal with the Central information Commission within ninety days from the date on which the decision should have been made by the first appellate authority. 5. PIO should communicate to the person whose application is rejected and explain: - The reasons for such rejection - The period within which an appeal against such rejection may be preferred; and - The particulars of the authority to whom an appeal can be made.

RTI Act 2005: Appeal to CIC The appeal made to the CIC should have : - Name and address of the appellant. - Name and address of the PIO appealed against. - Brief facts leading to the appeal. - Self-attested copies of the orders or documents against which appeal is made and copies thereof - If the appeal is preferred against deemed refusal, particulars of thereof. - Prayer or relief sought and Grounds thereof - Verification by the appellant.

RTI Act 2005 Complaints One can make a complaint to the Information Commission if: • An officer has not been appointed by the concerned public authority. • Assistant Public Information Officer has refused to accept his or her application or appeal for forwarding the same to the Public Information Officer or the appellate authority. • He has been refused access to any information requested by him under the RTI Act. • He has not been given a response to a request for information within the time limit.   15. RTI Act 2005 Complaints V. He/Shehas been required to pay an amount of fee which he considers unreasonable. vi. If he/Shebelieves that he/she has been given incomplete, misleading or false information.

RTI Act 2005: CIC • Appeals and Complaints • The Central Information Commission decides the appeals and conveys decision to the appellant and Public Information Officer. • The Commission may decide an appeal/complaint after hearing the parties to the appeal/complaint or by inspection of documents produced by the appellant / complainant and Public Information Officer or such senior officer of the public authority who decided the first appeal. • If the Commission chooses to hear the parties before deciding the appeal or the complaint, the Commission will inform the date of hearing to the appellant or the complainant at least seven clear days before the date of hearing. The appellant/complainant has the discretion to be present in person or through his authorized representative at the time of hearing.

  17. New India Assurance Company Suomotu disclosures(1/2) • The decision making process of the company Rules, Regulation, instructions, manuals and records, held by new India assurance company limited for use by its employees for discharging their function. • Documents pertaining to Accounts  -Books of Accounts. -Annual Reports -Documents pertaining to payment of Income Tax, Tax deducted at source.
