Renting of a land for agricultural purpose procedure in Greece Greek public property management belongs to the Ministry of Rural and Food Development. Land leasing is regulated by the Law 4061/2012 “Management and Protection of Rural and Food Development Ministry's property – Regulation of property rights and other provisions.” Decisions of renting a land property (specified in Law 4061/2012 (A 4)): a)Minister of Agriculture: More than 10 hectares Any purpose of use b)Regional Director where property is located: up to 10 hectares Professional farmers, agricultural production groups natural, registered unemployed. Purposes of renting a land: -Agriculture, energy crops, plants, manufacturing and industrial facilities, tourist facilities , renewable energy systems, installation of mobile phone antennas, quarries. Land for agriculture: The government motivates new farmers (Law 4061/2012 (A 7)): a) Extremely low cost per hectare b) Bonus points system (e.g. Unemployed registered in the records of the Employment Service. 180 points) Duration (Law 4061/2012 (A8)): 5 to twenty five 25 years (extendable to a maximum 10 years) Exceptionally 25 years, for investment purposes only Must not exceed 40 years. Rental payments(Law 4061/2012 (A 9)): on yearly or 3-month basis. General terms of use(Law 4061/2012 (A11)) e.g. The tenant is required to use the property for the purpose for which it was granted.
Renting of a land for agricultural purpose procedure in Cameroon The procedure • All the unexploited land is the sole property of the Cameroon Government confer:The law of 05 August 1974 on land regulations in Cameroon. • To obtain a land for agriculture activities summit an application to the Ministry of Domain and land tenure« arrêtéd’attributionprovisoire « • Payment 35euros to 100euros per hectare • The duration of land leasing varies 5 years to 90 years depending on the need of the state • After visiting the site the consultative commission provide a temporal permission and later on a land title • For private –private a Land leasing agreement is establish approved by the local Authority
Conclusion • Governments provide legal guidance to regulate agriculture activities in order to promote the individuals’ and societies' welfare. • The most significant difference the period of renting. (10 years to 90 years) • The mostdetailed land lending contract law is the Greek law, e.g “Bonus Points System” of renting. THE MOST SUITABLE LAW ?
