  1. Developments on Collaborative Approaches towards Screening and Assessment to Prevent Immigration Detention City Royal Resort Hotel, 29th July 2014

Introduction • UNHCR in Tanzania continues to advocate for the use screening and assessment with the relevant government institutions and non governmental organizations. • The main focus is to ensure that government officials are in position to make informed decisions, avoid wrongful detention, minimize use of resources and prevent unnecessary immigration detention.

  3. Current Activities On-going training on refugee protection and mixed migratory flows management with focus on UNHCR 10 Point Plan of Action and Guidelines to Detention including ATD. Interventions through provision of legal aid through IP’s (WLAC) Advocacy on-going for review of Refugees Act, 1998 to incorporate urban refugees On-going review of Immigration Policy

  4. Admission and Stay UNHCR works towards ensuring the government takes responsibility in: • Providing access to safety • Non penalization for unlawful entry or stay for asylum-seekers and refugees • Non-refoulement • Non expulsion

  5. Access to RSD procedures The Office works towards ensuring asylum-seekers continue to have regular access to RSD; Within a reasonable timeframe In a language the A/S understands Reasons for negative decision Right to appeal

  6. Access to Administrative Assistance • Documentation/evidence of legal status which prevents arrest and detention • Asylum-seeker certificate • Refugee ID Cards • Travel Documents • Civil status documentation • Birth Certificates (to avoid statelessness situations) • Marriage Certificates • Death Certificates • Etc …

  7. Return to Country of Origin • Everyone has the right to leave any country, including his own, and to return to his country (art. 13(2), UDHR • Repatriation should be : • Voluntary • In safety and dignity • Effective return arrangements for persons not found in need of International Protection

  8. Other rights • Refugees are entitled to the enjoyment of all Human rights : • Right to life • Freedom of movement • Education • Heath care • No discrimination on grounds of race, religion or COO • Freedom to practice one`s religion • Acquisition of movable and immovable property • Right of association • Access to courts of law • Employment • Housing
