  2. LEGAL STUDY Interaction between: • International and national laws, judgements, and institutional frameworks, and • Indigenous and Community Conserved Territories and Areas • International and 15 national-level studies

  3. RECOGNITION STUDY • Considers various legal, administrative, social, and other ways of recognizing and supporting ICCAs. • Together the two reports explored the ways in which Indigenous peoples and local communities are working within international and national legal frameworks to secure their rights and maintain the resilience of their ICCAs – including food systems.

  4. THREATS TO ICCAs • Development: industrial methods of extraction, production and development (Land conversion for large-scale livestock farms or monoculture plantations, infrastructure and dams, industrial fishing and logging, and large-scale mines) and, • Conservation: threats from exclusionary environmental and conservation frameworks that undermine the rights and livelihoods of Indigenous peoples and local communities. • Laws: support or undermine communities resilience to either disturbance.

  5. POSITIVE DEVELOPMENTS • Increasing amount of international law, and national legal and non-legal support. • Emerging jurisprudenceat the regional and local levels. • But laws and institutions continue to undermine the resilience of ICCAs, including local food systems.

  6. THE DEVELOPMENT, IMPLEMENTATION AND ENFORCEMENT OF LAWS IS DISCRIMINATORY • Many communities and supporting civil society organizations lack knowledge of legislative and judicial systems • Respect for human rights is severely lacking • Judicial systems are often a barrier to justice

LEGISLATION THAT UNDERMINES AND FRAGMENTS LOCAL SYSTEMS • Lack of recognition of customary laws and traditional authorities, institutions and decision-making processes undermines community cohesion • Lack of recognition of customary land rights is a fundamental issue • Very few rights over sub-soil resources • Marginal rights-based approach to natural resources and the environment • Protected areas laws are falling behind International rights • And, non-legal recognition and support of ICCAs remains absent, weak, or inappropriate

LAW IS THE BOWL • The law is a very significant factor in determining Indigenous peoples’ and local communities resilience to external threats. • In this light, it is the “bowl”. • The quality of the law changes the shape of the bowl, either supporting or undermining communities’ resilience to change.

RECOMMENDATIONS FOR OVERALL LEGAL REFORM AT THE NATIONAL LEVEL • Respect and uphold human (including collective or community) rights. • Improve implementation of legislation by harmonizing laws and undertaking institutional reform. • Improve access to justice and uphold the rule of law. • Support legal empowerment and capacity building initiatives.

LEGISLATE & IMPLEMENT LAWS FOR INTEGRATED SOCIO-ECOLOGICAL SYSTEMS • Recognize and respect customary and collective land rights. • Recognize customary laws and decision-making processes. • Reform agricultural, environmental and natural resource laws to enhance rights and remove direct threats. • Reform policies and laws to effectively protect and promote traditional knowledge, cultural heritage and customary practices.
