On their first day of work, employees often fill out the I-9 form. The employee is responsible for submitting personal information as well as establishing their identification and work eligibility with original documents such as a passport, driver's license, or birth certificate. In addition, the employee must supply their social security number, and the document must be signed and dated by the employee. The employer is also responsible for completing the "Employer or Authorized Representative Review and Verification" section of the form. The employer must evaluate the employee's original documents, verify that they appear to be authentic, and enter the 1/2

Employers are responsible for preserving the I-9 form for all employees, regardless of citizenship or national origin. The form must be maintained on file for three years from the date of hire or one year following the date of termination, whichever comes first. An employer can have a mobile notary public act as an authorized representative instead of completing the "Employer or Authorized Representative Review and Verification" part of the I-9 form. The notary public will evaluate the employee's original documents, verify that they are legitimate, and enter the document information into the form. The notary public must also sign, date, and submit their notary commission number on the form. It is vital to highlight that when the employee produces their original documents and completes the form, the notary public must be physically present. They cannot just sign and notarize the form without personally evaluating the documents.
