  3. 5 Private Security Industry Regulatory Authority REGULATION 1 Application for registration as a security service provider • An application must be submitted to the Director. • In the case of a natural person, the application must be accompanied by • the following: • relevant application fee (R74 – 20). • an authenticated copy of the first page of the official identity document.

  4. 6 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) proof to the satisfaction of the Authority that an applicant who is not a South African citizen has permanent resident status in South Africa. an authenticated, recent clear passport size photograph of the applicant. a clear and complete set of fingerprints of the applicant. a properly completed request for preliminary screening by the Service on the basis of the applicant’s name and identity number, if the applicant request such screening.

  5. 7 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) original police or other official clearance certificates on the criminal record status of the applicant. an original clearance certificate (ex SAPS, SANDF etc.). an original certificate or other proof that the applicant has compiled with the applicable training requirements. a valid undertaking regarding suretyship or guarantee (directors, members, trustees, etc.).

  6. 8 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) • relevant application fee and other amounts prescribed (R 4 000-00) • duly completed applications for registration and prescribed information of all directors, members, partners, trustees etc. • In the case of a security business the application must be accompanied by the following: • an authenticated copy of the CK1 and CK2 documentation if the applicant is a close corporation.

  7. 9 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) an authenticated copy of the CM1, CM2, CM27 and CM 29 documentation if the applicant is a company. shareholders particulars. an authenticated copy of the partnership agreement if the applicant is a partnership. an authenticated copy of the trust deed and the letter of authorization to the trustees from the Master of the High Court if the applicant is a business trust.

  8. 10 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) an authenticated copy of the documentation establishing the foundation if the applicant is a foundation. a tax clearance certificate from the South African Revenue Services. sufficient information in writing in regard to infrastructure and capacity. a resolution by the applicant security business to apply for registration as a security service provider.

  9. 11 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) Besides the statutory requirements for registration, the Authority may register a security business as a security service provider if- the applicant meets the requirements in respect of infrastructure and capacity or will meet such requirements when commencing with its business activities in the rendering of a security service. the applicant demonstrates to the satisfaction of the director, it is likely to commence with its business activities in rendering a security service within a period of 3 months after registration.

  10. 12 Private Security Industry Regulatory Authority Application for registration as a security service provider (…..cont’d) The persons referred to in Section 21(1)(a)(iii), (iv), (v), (vi) and (vii) of the Act (directors, members, trustees, etc.) providers the suretyship or guarantee that the director may deem necessary to ensure compliance with the financial obligations of the applicant towards the Authority.

  11. 13 Private Security Industry Regulatory Authority REGULATION 3 Training requirements for registration as a security service provider Every natural person applying for registration as a security provider must have successfully competed at least the training course described and recognized as “Grade E”. Every person contemplated in section 21(1)(a)(ii), (iii), (iv) or (vii) of the Act (directors, members, trustees, etc.) who applies for registration as a security service provider, must have successfully completed at least the training course described and recognized as “Grade B”.

  12. 15 Private Security Industry Regulatory Authority REGULATION 4 Clearance certificate : Ex-Members of any official Military, Security, Police or Intelligence Force or Service “former employer” means any official military, security, police or intelligence force or service, whether in South Africa or elsewhere, or its successor in law, of which an applicant is a former member. An applicant must submit a clearance certificate of all his or her former employers. In the case of the former employer no longer existing, the Authority may- hold over the application for registration pending further investigation and consideration of the background of the applicant; and

  13. 16 Private Security Industry Regulatory Authority Clearance certificate : Ex-Members of any official Military, Security, Police or Intelligence Force or Service (…..cont’d) if it is reasonable to do so in the circumstances and after obtaining the consent of the Council, register the applicant as a security service provider if it considers the applicant a fit and proper person to render a security service.

  14. 17 Private Security Industry Regulatory Authority REGULATION 5 Infrastructure and capacity necessary to render a security service Every security business applying for registration as a security service provider must- Furnish factually substantiated information in writing to the Authority on the nature and scope, including the geographical area, of the applicant’s intended and likely activities in rendering a security service for at least a period of 1 year after the commencing with its business activities; and Demonstrate, through the declaration with such substantiation to the satisfaction of the Authority that the applicant will meet the following minimum requirements at the commencement of its activities and is likely to continue to meet these requirements for at least 1 year after such commencement.

  15. 18 Private Security Industry Regulatory Authority Infrastructure and capacity necessary to render a security service (…..cont’d) The applicant has at its disposal an administrative office, consisting of at least one room dedicated for this purpose, which must be an immovable structure, situated at a place that is reasonably accessible to the inspectors of the Authority, the clients of the security business and the security officers that are used by it to render a security service, and at which reasonable office hours are maintained. The applicant’s administrative office contains all the equipment which is reasonably necessary for the effective management and administration of the affairs of the security business.

  16. 19 Private Security Industry Regulatory Authority Infrastructure and capacity necessary to render a security service (…..cont’d) The applicant’ administrative office and internal systems meet any reasonable requirement that the Authority determines in terms of the Act. The applicant has at its disposal as many administrative office satisfying the requirements of this regulation. The affairs of the applicant are managed and controlled by appropriately experienced, trained or skilled persons. The application has its disposal a sufficient number of registered and appropriately trained and skilled security officers for the rendering of a security service for which it has contracted or is likely to contract.

  17. 20 Private Security Industry Regulatory Authority Infrastructure and capacity necessary to render a security service (…..cont’d) The security officers used by the applicant in the rendering of a security service are properly controlled and supervised. The applicant has at its disposal a sufficient number of adequately skilled administrative staff members for the purpose of the administration of the affairs of the applicant. The applicant has at its disposal the financial means to ensure payment of the lawful wages to all the security officers and administrative staff used by it.

  18. 21 Private Security Industry Regulatory Authority Infrastructure and capacity necessary to render a security service (…..cont’d) The applicant has all the necessary equipment, including vehicles and properly trained working animals, if applicable in the circumstances, as well as the uniforms, clothing and equipment that must be issued to its security officers in view of the nature of their functions, at its disposal to enable it to render a proper security service for which it has contracted or is likely to contract; and The applicant is in lawful possession of the firearms and other weapons that are necessary to render the security service in respect of which it has contracted.

  19. 22 Private Security Industry Regulatory Authority Infrastructure and capacity necessary to render a security service (…..cont’d) The Authority conduct inspections to establish whether applicants meets the requirements. At any time after registration, the Director of the Authority may issue directives to establish whether the infrastructural and capacity requirements of a business are still being met.

  20. 23 Private Security Industry Regulatory Authority REGULATION 6 Register of security service provider and related issues The registration which is kept by the Authority contains, inter alia, the following: the registration number on the registration certificate issued by the Authority. the date of the registration certificate. the residential and business or employment address (street address and postal address) and telephone contact particulars of the security service provider.

  21. 24 Private Security Industry Regulatory Authority Register of security service provider and related issues (…..cont’d) the full first names, surname, identity number, date of birth and citizenship of the security service provider if such provider is a natural person. the particulars of the security service or services rendered by the security service provider as well as the category of security service providers into which the provider is classified by the Authority. the name of the security business, every name under which the security business is trading, the branches of the security business, the name of every person referred to in Section 21(1)(a) of the Act (directors, members, trustees, etc.).

  22. 25 Private Security Industry Regulatory Authority Register of security service provider and related issues (…..cont’d) the name of the employer of a security service provider who is a security officer. particulars of every conviction of improper conduct in terms of the Act and the repealed legislation. particulars of firearm licenses and permits issued to a security service provider.

  23. 26 Private Security Industry Regulatory Authority REGULATION 7 Change of name and status of security service provider An application to change the name of registered security business or trading name must be submitted to the Director:- on the prescribed form accompanied by documentation in respect thereof payment of the prescribed amount An application to change the name of a natural person must be submitted to the Director within 7 days of such a change –

  25. 28 Private Security Industry Regulatory Authority Change of name and status of security service provider (…..cont’d) A registered security service provider who wishes to occupy a position contemplated in Section 21(1)(a)(ii), (iii), (iv), (v) or (vii) of the Act (directors, members, trustees, etc.) in regard to a particular security business must submit an application to the Director – on the prescribed form accompanied by documentation in respect thereof payment of the prescribed amount

  26. 29 Private Security Industry Regulatory Authority Change of name and status of security service provider (…..cont’d) Penal Provisions Security business failing to advise Authority of change of name – 6 months imprisonment/fine. Security service provider assumes position of director, member, trustee, etc. (Section 21(1) without Authority’s approval – 12 months imprisonment/fine).

  27. 30 Private Security Industry Regulatory Authority REGULATION 8 Change with regard to information submitted to the Authority A security service provider- Must inform the Authority within 10 days of any change in regard to any information submitted in writing to the Authority. Must, in the case of a security business, annually during November submit a return to the Authority with the information required on the form approved by the Authority for this purpose.

  29. 32 Private Security Industry Regulatory Authority REGULATION 9 Certificates of registration, identification and appointment Certificate of registration contains the name and registration number of the security service provider, etc. Certificate of identification in the form of a smart card and contains name and registration number of the security service provider, etc. Security service provider must carry his/her certificate of identification when rendering a security service or wearing the uniform of the business in public.

  30. 33 Private Security Industry Regulatory Authority REGULATION 10 Keeping of records and documents Every security business must keep the originals of all records and documents, available for inspection by the Authority – At the administrative office or if the business has more than one administrative office, at the relevant office servicing the area. Records to be kept for 4 years. Records must be updated not later than 7 days after a change. Records may be kept and maintained in an electronic format and must ensure that a marked electronic backup is kept. .

  31. 34 Private Security Industry Regulatory Authority Keeping of records and documents (…..cont’d) The records and documents that must be kept, include: a list or register with the full first names and surname, identity numbers, registration number and residential address of every security officer and other person employed or deployed by the security business (employees and independent contractors). a list or register with the full first names and surname, identity number, registration number and residential address of every security officer made available or whose services are made available by the security business to another security business or any person.

  32. 35 Private Security Industry Regulatory Authority Keeping of records and documents (…..cont’d) a register containing full information on the wages and remuneration paid including deductions made to all security officers and other employees of the security business (BCEA2). true copies of all payslips in respect of security officers and other employees of the security business (BCEA4). An attendance register in respect of all security officers and other employees of the security business (BCEA3). A posting sheet containing the following particulars in respect of every day or part of a day during which the security business renders a security services:

  33. 36 Private Security Industry Regulatory Authority Keeping of records and documents (…..cont’d) the full first name and surname, and the level of accredited security training of ever security officer utilized in connection with the rendering of a security service in respect of that day or part thereof. the registration number of every such security officer. the name of every client to whom a security service was rendered and the address and place or places where such service was rendered. the nature of the security service rendered. the duration of the security service rendered.

  34. 37 Private Security Industry Regulatory Authority Keeping of records and documents (…..cont’d) whether a security officer was provided with a firearm or other weapon, and if so, the type of firearm or weapon, its proper identification number if any, as well as information on the legal authority in terms of which the firearm was provided and possessed; and Particulars of ammunition provided to a security officer. Personnel files on each security officer, employee or official containing at least- every written contract concluded with such person, as well as a description of the duties or functions of each person.

  35. 38 Private Security Industry Regulatory Authority Keeping of records and documents (…..cont’d) written particulars of employment as contemplated in Clause 13 of Sectoral Determination 6. a record of all disciplinary steps, including suspension from duty, taken against such person by the security business. a true copy of official documentation indicating the level of accredited security training and other relevant training of such person; and

  37. 40 Private Security Industry Regulatory Authority REGULATION 10 Keeping of records and documents (…..cont’d) legal authorization in the form prescribed by law in respect of the possession and use of firearms and other weapons by the security business and its security officers. documentation indicating full particulars of all deductions and payments which are made to the Authority. all other records or documents which the security business must keep in terms of the Act or any other law applicable to a security business. Penal Provision Fine/24 months imprisonment

  38. 41 Private Security Industry Regulatory Authority REGULATION 11 Application for suspension or withdrawal of registration Apply to the Authority for suspension or withdrawal of registration as a security service provider. In the case of any suspension, the relevant person can request the Authority to uplift the suspension.

  39. 42 Private Security Industry Regulatory Authority REGULATION 12 Specifying of registration numbers and other information on documents The following information to be displayed on any document or advertisement- the name under which the security business is registered as a security service provider by the Authority, as well as the name under which it trades. the expression “Registered as a security service provider by the Private Security Industry Regulatory Authority, registration number …”. , where the registration number is the number provided in the register.

  40. 43 Private Security Industry Regulatory Authority Specifying of registration numbers and other information on documents (……cont’d) the street address and postal address of an administrative office of the security business, a telephone contact and facsimile number of the security business at that office, as well as the name and the telephone contact number of an official of the security business performing executive or management functions in respect of the security business. Penal Provision Fine/6 months imprisonment

  41. 44 Private Security Industry Regulatory Authority REGULATION 13 Uniforms, insignia, badges and firearms Every security business must provide every security officer in his employ with a sufficient and distinctive uniform and every security officer must wear the uniform provided. Exclusion: Security officers rendering a service consisting of the protection or safeguarding of a specific natural person. The uniform – must be suitable for use by the security officer in view of the nature of the security service rendered, the circumstances under which the security service is rendered and any other relevant circumstance; and

  42. 45 Private Security Industry Regulatory Authority Uniforms, insignia, badges and firearms (…..cont’d) must have at least 2 badges, prominently attached to the uniform, with the same name of the security business employing the security officer clearly legible on them, as well as a badge, attached to the front top part of the uniform, with the name and registration number of the security officer clearly legible on it. The Director of the Authority may issue directives in respect of businesses uniforms.

  43. 46 Private Security Industry Regulatory Authority Uniforms, insignia, badges and firearms (…..cont’d) A security business which renders a security service requiring the possession or use of a firearm, must lawfully provide a suitable firearm for that purpose and may not require or permit a security officer employed by the security business to obtain or provide a firearm for that purpose. A security officer may, for the purpose of rendering a security service in the course of his or her employment, only posses a firearm lawfully provided by his or her employer. Penal Provision Fine/24 months imprisonment.

  44. 47 Private Security Industry Regulatory Authority REGULATION 14 Transitional and general provisions Every “existing security officer” who was registered as a security officer in terms of the previous Security Officers’ Act, is deemed to have been registered in terms of PSIRA, 2001. An “existing security officer” who is a person contemplated in Section 23(5) of the Act (in the employ of SAPS, SANDF, etc.) are not deemed to have been registered in terms of PSIRA, 2001. A person using his or her own employees to protect or safeguard merely his or her own property or interest (In-House) must after 1 March 2003 –

  45. 48 Private Security Industry Regulatory Authority Transitional and general provisions (…..cont’d) only use employees registered as security service providers. before implementation of the Levies Act, comply, with the necessary changes, with the provisions regarding the deduction and paying over of the prescribed amounts. comply with all other provisions of the regulations in respect of the keeping of records, change with regard to information submitted to the Authority and uniforms, insignia and firearms.
