6.01 Influences on US law • Jurisprudence- the study of law • US law can be traced back way before the United States was created. • Ancient laws • Code of Hammurabi: early set of written laws and their punishments (legal code) • Ten Commandments: (legal and moral code) • Draconian laws- Greeks first written code of law • Justinian Code- codified Roman law into one uniform set of laws
British Influences • Magna Carta • English Bill of Rights • British common law • Law based on tradition or past court decisions • This is why we view Supreme Court decisions as law
Native American Influences • Iroquois League • Many Iroquois tribes banded together and they came to dominate other Native American peoples • Inspired Benjamin Franklin and his Albany Plan of Union (it failed to happen)
6.02 Types of laws • Criminal law • Define what actions are regarded as criminal acts against the state. • Government vs. an individual • Burden of proof: beyond a reasonable doubt • Civil law • Concerned with relationships between people • Individual vs. individual • Burden of proof: preponderance of the evidence • Family law: marriage, divorce, adoption
Public law • Deals with relationships between people and the government • Constitutional law: interpretations of the constitution (Brown v Board) • Administrative law: governs the operation of government agencies: OSHA, FCC, FDA, EPA • International law: laws that apply to all nations • Statutory law- any law that enacted by a legislative branch. Any act passed by a legislative (Americans with Disabilities Act)
