In India the judiciary is at the apex of the whole system. The citizens of India hold the full-fledged right to approach the judiciary in times of misery and whenever they feel that their fundamental rights are endangered by an act executed by the executive.

  1. The Role of Judiciary in India Judiciary and its Functions In India the judiciary is at the apex of the whole system. There’s a high court in every state in India. Below the high court there are district courts and then there are courts at the lower most level. The judiciary, independently safeguards the interests of the people. The judiciary is known to be the guardian of the fundamental rights and duties and the curator and protector of the provisions of the constitution. Judiciary and its functions are humongous and it holds the power to assert void, anything or everything that is violative or paradoxical of the provisions of the constitution of India. The importance of judiciary in democracy is immense and it has the power and the authority to sue anybody and it ensures neither the legislatures nor the executive violates or can ride rough over the rights and interests of the people of India.   2. Court and high court are appointed by the President in reconciliation with the chief justice of the Supreme Court and on the advice of the Prime Minister in power. This system has been successful over the years and has worked pretty well. There haven’t been any instances of the executive intervening in the work of the judiciary therefore it is quite evident that this system is flawless and propagates peace. According to the constitution the judges of the Supreme Court and the High Court can’t be removed by an executive authority and can only be removed by impeachment. The impeachment of the president is parallel to the impeachment of Supreme Court and high court judges. But, there hasn’t been an instance where a judge in India was removed by impeachment. The citizens of India hold the full-fledged right to approach the judiciary in times of misery and whenever they feel that their fundamental rights are endangered by an act executed by the executive. Public interest litigations too, enable citizens to approach the courts. Whenever the executive tries to misuse its power immediate actions are taken by the judiciary to curb its powers. While the people of India have their fair share of reservations about the legitimacy of the actions of the government, they have profound faith in the judiciary and this in every which way is a good indication of the good health and survival of the judiciary in our country.
