WHO CANNOT ENTER ITALY

You cannot enter the Italian State territory if you have been:

  • Expelled and have left Italy for less than 10years-unless diversely stated- and at all events for a period not shorter than 5 years.
  • Notified as unwanted or dangerous person according to the International Agreements;
  • Judged as threatful for the public order, for the Country security or for one among the Schengen Agreements Countries ;
  • Charged for drug-dealing; sex crimes; aiding and abeiting the clandestine immigration; exploitation of prostitution and of minors.

SUBSISTENCE

  • TO ENTER AND STAY IN THE ITALIAN STATE TERRITORY YOU MUST PROVE TO HAVE MEANS OF SUBSISTENCE, THROUGH :
  • liquid cash money exibition;
  • bank guarantees;
  • insurance policies;
  • equivalent credit instruments
  • vouchers for pre-payed services or other documents demonstrating access to sources of income in Italy.
  • Furthermore you must prove to have :
  • An appropriate accomodation

SELF-MADE JOB

Means of subsistence are on charge of the worker who must show evidence to have:

  • Minimum 388.00 € to pay the National Health Insurance valid for the entire stay.
  • The existence of a suitable accomodation.
  • The money for repatriation, who can be proved also by showing a prepaid return travelling ticket.

Foreigner who has got a Training Certification obtained attending one of the classes sanctioned by the Ministry of Work

ACCOMPANYING FAMILY AND FAMILY

REUNION

Subsistence and a suitable accomodation are on the worker’s charge.

  • If you own an Italian pass or a stay permit you can ask the entrance for “accompanying family” or “family reunion” providing that you show evidence to have:
  • A suitable home to live in with your relatives, according to the Italian law.
  • A minimum income of 5’061.04€ for the year 2007 for one relative; 10’123.36 € for two up to three relatives; 15’185.04 € for four and more relatives.Iffamily reunion is required for more than a minor child, must show evidence of an income double than the annual allowance.

Subsistence and a suitable accomadation are on the student’s charge.

STUDY

  • You must show evidence to have:
  • 350,57€ per each academic year’s month (also through personal or familiar commodities)
  • the existence of a suitable home to live in, in compliance with the Italian Law;
  • the money for the repatriation who can be proved also showing the return ticket.
  • 149,80 €. for the National Health Service or a Medical Insurance Policy valid during the period of your stay.

Scholarships sums up the subsistence money or the Health Service’s fee.

  • THE APPLICATION FORM MUST INCLUDE:

EXEMPTEDCOUNTRIES

Nationals of some Countries are not obliged to entry Visa for tourism, mission, business, invitation and sports competition’s grounds, provided that the stay is not longer than 90 days.

PASS for ADOPTION

Enables to adopt a foreign minor for a permanent stay.

Requirements:

  • Named Authorization issued by the International Adoptions Committee
  • Declaration of Adoption Suitability issued by the Italian Juvenile Court to which the petitioners belong to.
  • Adoption measure or pre-adoptive custody issued by the foreign Authority in conformity with the local laws;
  • A Foreigner Country Law comformity’s declaration issued by the Italian Consular Authorithy having jurisdiction .

The adopted under-age, once arrived in Italy, acquires authomatically

the Italian citizenship.

PASS for BUSINESS

ALLOWS TO ENTER FOR NEGOTIATIONS.

Requirements:

  • Statement of the “entrepeneur” ’s status of the petitioner;
  • the business grounds of the journey ;
  • the real existence of the Italian entrepeneur who applies on alien’s behalf for the pass issueing,
  • suitable subsistence.

Pass issue will be faster if the foreign ENTREPENEUR has a “Declaration of invitation ” made by a regularly registered firm in Italy.

Business pass can also be issued for the companions, provided that the business’ aims could be certificated.

Once in Italy, the foreign petitioner, DOESN’T HAVE TO APPLY FOR

A STAY PERMIT, but has to fill a DECLARATION Form stating his/her

PRESENCEat the Police Headquarters within 8 working days from the arrival

PASS for MEDICAL TREATMENTS

Enables to have medical treatments if you need them in the Italian hospitals or clinical surgery

IT DOESN’T ALLOW TO WORK

Requirements:

  • Declaration issued by the Italian Hospital or clinic selected stating the treatments you need, the starting-date and the duration of it;
  • Certification of insurance policy , calculated on the total medical expenses.
  • Certification of avalaibility of board and lodging for the companion.

The pass for medical treatment can be issued also for the alien’s companion, provided that there are proper means of subsistence.

The companion of those minors suffering from psyco-phyisical diseases, can have a “minors-assistance”- stay permit , which enables to work, but is not convertible into an “employment stay permit”

DIPLOMATIC PASS

  • Diplomatic passport enabling the diplomatic mission c/o your own Country, Italy and the Holy See.

Diplomatic pass for accrediting or notification allows you to enter Italy if you own a:

Petitions must be issued through the Diplomatic office, with a verbal note enclosed, and the pass’ issueing will always be dependent on the previuos permit issued by The Ministry of Foreign Affairs’ Ceremonial Act.

Diplomatic pass is issued also to close relatives of the fereigner petitioners.

  • an EC residence permit.(formerly “residence card” )

Enables you to enter Italy accompanying a relative holder of a pass for:

  • Availabilty of a suitable home in order to put you up;
  • an income of 5.061.68 € for the year 2007 for one relative, 10.123.36€. for two-three relatives, 15.185.04€ for four and more relatives;
  • a certification about the relativeness degree (such as personal data and registry office) family registration and minor age condition; invalidity or illness; unfitnessy to work; to be adependant relative; such certification must be issued from the Country of origin’s Authority and authenticated by the Italian Consulate;
  • Sanitary certification issued from the local Healt Service board.

ENABLES THE PARTECIPATION TO SINGLE COMPETITIONS OR SPORTS CONTESTS-BOTH AS A PROFESSIONIST OR AN AMATEUR, IF YOU ARE:

Requirements:

  • C.O.N.I. confirmity declaration of the competition and a notification of the athlete or team’s partecipation.
  • An official list with the names and the sporting activities of each competitor.
  • Subsistence money.

ENABLES ENTERING ITALY FOR POLITICAL, GOVERNMENT OR PUBLIC UTILITY WORKS .

IT IS ISSUED TO:

Those foreigners who have political dignity or holding public offices for international Committees, invited to Italy to see their works through:otherwise those citizens who, due to their holdings are considered as public utility for the relationships between Italy and their Country

RELIGIOUS GROUNDS

  • A foreign priest;
  • A cult ministry belonging to one of the Minister of Interior Committee’s Lists;
  • partecipating to a religious manifestation;

PERMITS THE ENTRANCE IF YOU ARE:

Requirements:

  • The effectiveness of the clerical status;
  • A certification about the religious manifestation he/she is going to take part to;
  • Applicant must have his own subsistence money if the stay expenses are not on charge of the Religious Institution.

PASS FOR CHOICE of RESIDENCE

It enables to settle down in Italy if you have got enough means of subsistence to allow you not to work.

Requirements:

  • Availability of a home to choose as residence;
  • independent and large economic resources given for sure in the future(such as life annualities, real estates, other incomes by different trading activities..etc. ).

The same pass can be issued to holder’s relatives having suitable subsistence.

You can have this kind of pass also if you are a retiree

PASS FOR FAMILY REUNION

Enables to rejoin your relatives if they are regularly resident in Italy.

  • Spouse ;
  • dependant minor children, or also adults unable to work;
  • dependant parents with a certification of their hillness;
  • children in adoption to an Italian couple

It can be required for these relatives:

  • An EC Stay permit (ex residence card)To have already the residence card or pass for at least one year for employment / self employment/asilum/study or religious grounds;
  • to have a proper home;
  • annual income of about 4.962,36 €in the 2006 for one relative;of 9.924,72 € for two three relatives, of 14.887,08 € for four and more relatives.

PASS FOR STUDY

Enables entering Italy if you want to attend University courses, training classes c/o Authorized School, or if you are invited for researching activities

Requirements:

  • A valid Identity card;
  • A certification about the classes you are going to attend (such as The University application form );
  • suitable subsistence(not less than 350,57 €per each month of academic year) or scholarships;
  • A certification about a proper accomodation;
  • The money for re-patriation also by showing prepaid return ticket
  • Medical insurance
  • aged more than 14.

PASS FOR AIRPORT-TRANSIT

Permits to transit those countries proved to be on the way of your businesses, and it is issued at the only condition that you are allowed to enter the final destination Country

Pass issueing depends on:

  • The existence of the minimum requirements - in general, for the issueing of a short lenght pass such as those for tourism
  • the foreigner who has got a visa for the final destination Country.

Pass for airport transit is also issued for Seafarers who want to go on board or land from foreigners ships, to the harbours located in Italy or in the Schengen area

PASS FOR TRANSPORTATION

Permits entering the territory if you have to come for short periods only for trading and transportation of people or goods

(truck haulage; charter flights crews)

Requirements:

  • A certification of the occupational conditions of the applicants
  • a certification about the kind of work the petitioner is going to attend during the stay.

PASS FOR TOURISM

It’s a permit to travel for touristic purposes.(max.lenght 90days)

  • Enough subsistence money;
  • a return ticket ( also a booking receipt) otherwise the availabilty of own transportation;
  • a suitable accomodation (hotel reservation;certification of hospitality)

Requirements

If the foreigner has been invited by a citizen regularly resident in Italy , a declaration of invitation is needed, proving the existence of subsistence, on the contrary, the declaration must enclose a deposit’s receipt c/o an Italian bank for the subsistence amount required, issued by the host in favour of the foreign applicant,

For those minors invited according to umanitarian or touristic agreements, such as those approved by the “Guardianship of foreign minors Committe” is needed:

“a) The assent to espatriation given by the minor’s guardian or by the parental authority;

b) a written authorization issued by the same Committee.

IT DOESN’T ALLOW TO WORK.ON EXPIRY DATE CANNOT BE CONVERTED INTO A DIFFERENT KIND OF PASS.

PASS FOR WORKING-HOLIDAYS

Allows entering Italy if you belong to one of those Countries with which Italy agreed upon (art.27 T.U)

The pass has a max lenght of two years.For the foreign sportsmen the working permit can be substitued by a Coni named consent declaration.(art.40 comma 16)

Pass issueing requirements are according to the International Agreement in the matter, considering the existence of proper means of subsistence.

WHAT TO DO ON ARRIVAL.

If you are holder of a Familiar grounds Visa or a First Entry Employment Visa

you must go, on your arrival, to the Immigrants Counter(Sportello Unico) within 8 days in order to:

  • sign the contract of employment (in case you get a job );
  • to request the working permit;
  • apply for the stay permit;
  • to get a fiscal code.

If you own an Entry Visa for the enlisted grounds:

Business, Medical treatments; Sports Competition, Mission, Umanitharian, Political Asylum , Minors-Assistance, Justice, Sateless Condition, Juvanile integration, Ivitation.

  • On your arrival,within 8 days, you must apply to the Police Headquarters (QUESTURA) in order to:
  • request your stay permit:
  • to get your fiscal code.

RESIDENCE PERMIT FOR STUDY REASONS

The issuing modality are different according to the type of the course undertaken in Italy.

  • For the issuing are needed, in addition to basic documents, also:
  • an University or School enrolement statement plus nr.2 two photocopies of it;
  • An original plus nr.2 Photocopies of the documentation certifying the availability of adequate financial resources for the validity period of the residency permit.

VALIDITY : max. 1 year. the renewal will be valid for all the lenght of the courses.

RESIDENCE PERMIT FOR POLITICAL REFUGEES

ISSUED TO: those aliens who, for race, religion social or polytical membership are persecuted in their country of origin, reason why he/she must leave it.

  • APPLICATION FORM: to be submitted to the Border Police when entering Italy.It must contain:

  • the reason for the recognition of political refugee or asylum.

The central Committee for the recognition of the status of refugee provides to check the documentation, after the Police Headquarter issues a one month valid stay permit.On expiring date it’s issued another one for “asylum request” valid 3 months which is renewable (it doesn’t enables to work)

PERMIT RENEWAL

PERMIT RENEWAL means a new stay permit.It is issued on the basis of the real activity done. Its validity cannot exceed that of the first issuing.

  • 60 days before - for no limit time employment;

PERMIT’s CONVERSION

RESIDENCE PERMIT can be converted into another valid document, also in case of renewal, if all the requirements occurr.

  • CONVERSION IS NOT NEEDED IN EVENT OF:

PERMIT RENEWAL’s REJECTION

Whenever the ruling laws of the E.U.States and the Italian Testo Unico requirements are not fulfilled in order to issue a residence permit, a rejection with a written documentation will be issued in a language the seeker can understand, with appeal modalities.

The “Residence card” has now been replaced by the

“ Ec long term residence permit”and it is issued to alien citizens holder of a valid stay permitand living in Italy at least for 5 years, with absencies not exceeding 6 continuosly months, and in any case not exceeding 10 months during the overall 5 years.

EC LONG TERM RESIDENCE PERMIT

Application must be submitted through the yellow striped kit or filed to the PATRONATO-INAC and sent through a return registerd letter to the competent Questura, under payment of a 30€ fee to the Post office. An electonic format Ec’s Residence permit will be issued within 90 days and it allows permanent stays.

  • Copy of the passport or other valid document i.e. an Italian I.C. issued by the Municipality of the town of residence;
  • N.4 passport size photos;
  • a 14.62€ revenue stamp;
  • €27.50 payment’s receipt (for the issue of the electronic permit);

SELF MADE JOB

  • Whichever self made job are you going to start (industrial, handicrafts, commercial, companies etc,) you are requested to have moral and professional skills according to the Italian Law, as for any other Italian citizen, in order to undertake the working activity,and, if required, a registration to the Notice Boards;

  • Apply for a preventive authorization for the job to undertake, at the respective corporation, stating the absence of obstacles for the issuing of a proper commercial licence.

DOMESTIC WORKERS

Domestic workers attend only to their employers’ housekeeping (general servants; waiters, cooks, nurse-maids; house maids etc.)

Employers can take on domestic workers directly.

If the domestic worker is an alien, the employer must submit at a Post Office a work authorization in order to obtain a subordinated work permit. Besides, he has to send the RESIDENCE AGREEMENT(by Return registerd letter)to the Sportello Unico before of his/her coming to Italy(in compliance with Flows’ Decree).

  • In the Application form the Employer has to :
  • ensure to give to the worker a monthly retribution
  • guarantee him/her at least 20 weekly working hours;
  • to prove to have a suitable yearly income;
  • to ensure him/her a suitale accomodation;
  • be charged with both the journey and repatriation expenses;
  • self commit in referring any working agreement’s variations.

DISMISSAL or RESIGNATION. LOSS of the JOB.

dismissal, resignation, or the loss of the job aren’t a right cause to deny the alien worker and his/her legally resident relatives the residence permit.

Alien can also apply for a residence permit for job search valid 6 months

The alien worker holder of a employment stay permit who looses the job, also in case of resignation, can enrole the Employment Office lists for the remaining permit validity, and for a period not shorter than one year, unless in case of a seasonal work permit.

After one year of enrolement, if unemployment conditions still exist, the employment residence permit won’t be renewed anymore.

The foreign citizen, holder of a regular residence permit, WITH THE HEALTH INSURANCE CARD can immediately enter the National Health Sevice’s (SSN) medical care, under the same conditions and equal rights as the Italian citizens.

VOLUNTARY HEALTH SERVICE REGISTRATION

Aliens who haven’t got a residence pemit (which gives the right to a compulsory Healt Service registration ) and need medical treatments, must:

  • SUBMIT A VOLUNTARY HEALTH SERVICE REGISTRATION, GRANTED ONLY WHEN:
  • The alien holds a residence permit valid for a period longer than 3 months;
  • He/she pays € 387,34 as annual fee, also valid for dependant, or cohabitant relatives.
  • Sign a HEALTH INSURANCE POLICY.
  • If you are a student you can submit the voluntary Health Service Registration also for periods shorter than 3months, and should pay € 149,80 as annual fee;
  • If you are an “au-pair” worker can submit the voluntary registration under payment of an annual fee of € 219,49.
  • For those relatives who aren’t to be cared for there is a € 387,34 fee to pay.
  • if you hold a medical treatments or touristic purposes residence permit, this kind of health registartion won’t be issued.

HOW TO GET IT:

  • the worker has to request a two copies sickness’ certificate to the doctor in attendance ;
  • within 2 working days the copy stating the diagnosis and the prognosis must be submitted at the local Previdence centre (also by registered letter): the other copy must be given to the employer; Indemnity won’t be due for each day of delay in delivering the certificate.
  • The worker must fill the sickness’ certificate in with the exact address, for traceability during sickness in case of official medical check; an uncorrect address will cost the loss of the allowance;
  • The worker is bound to duty to be home for official medical cheks (from both INPS or Asl)during these daily hours:from 10.00 to 12.00 a.m. and from 17.00 to 19.00 p.m.: sundays and public holidays. In case of unjustified absence allowance will be denied.

EXPULSION

tHE EXPULSION ORIDNANCE is a legal notice to leave Italy within 15 days.Expelled alien cannot reenter Italy for 5 years.

  • it is pursuant to a decree in case of:
  • the alien refuses submission to border control;

MATHERNITY LEAVE AND ALLOWANCE

has the right to:

Regularly employed female alien

  • ask for the motherhood leave, which enables to be off work for two months before and three after the childbirth.In this period a motherhood allowance will be given( 80% out of the pay)
  • ask the parental leave (optional leave) for six months max, during which a reduced pay will given (30%)
  • after the childbirth, the brest-feeding dayly leave as well as to baby sickness leaves;

MATHERNITY

PREGNANT ALIEN without residence permit:

CAN’T BE EXPELLED

Until the baby isn’t aged 6 months during which also the husband can’t be expelled, though entered Italy as a clandestine, only if he lives with his wife .

The pregnant immigrant, in this case, has the right to submit at the Police Headquarters(QUESTURA) a residence permit request for pregnancy, with her personal data, the address, 6 passport size photographs, a 14,62 euros revenue stamp and a pregnancy certification-issued by the Local Health Center( ASL) - stating the presumably date of the bitrth.. Once obtained the residence permit the alien can register herself to the National Health Service in order to be exempted from the fees payment due for all the medical treatments needed during pregnancy.

The “pregnancy purposes” residence permit, in any case, doesn’t allow to leave Italy, nor to work, not even to be transformed into another type of permit, unless exceptional cases occurr.

FAMILY

Family law is intended also as the right and the duty to support , to bring and educate children, to keep them, the right for the parents and the minor children to live together as an united family is fundamental to men, hence also to aliens.

In compliance with the Italian law, the family reunion status is recognized providing that the immigrant is able to ensure to his relatives “good life’s conditions”.

The immigrant holder of a residence card o a residence permit for employment or religious purposes, valid at least one year, can apply for a family reunion permit for these relatives :

HOW TO GET MARRIED IN ITALY

Each citizen who is not yet married can apply for a marriage request .Minors aged 16 to 18 must be previously authorized from the Juvenile Court .Application form must be submitted at the weddings’ dept.in the Town hall.

HOW TO SEND MONEY HOME

If you are a worker and need to remit money home; if you are a student and need to receive money from home, within a short time and safely, we recommend you to apply to one of the specialized money tranfer’s offices.

To use this facility all you need is a valid Identity card, recognized by the Italianauthorities.

HOW TO BECOME A FARMER

In Italy alien wokers can also undertake a farm enterprise as Farm Entrepeneur (IAP)

  • You have the professional skills and competences needed;
  • if you have a VAT code:
  • if you are enlisted at the Chambre of Commerce’s Boards;
  • If you run lands as owner or with life interest or as share-farmer;
  • if you have a previdence for Insurance (INPS).

You can work as farmer if:

  • if you have been working as a farmer at least for two years;
  • if you have attended a holiday-farm entrepeneur’s class ;
  • if you spend the 85% out of all the faming activity’s time in the holiday-farm management .

Each taxpayer must have a FISCAL CODE

SUBMIT an ANNUAL UNIFIED TAX RETURN “FORM UNICO” TO STATE:

“ FORM 730”

IN ORDER TO:

  • Overall Incomes earned by one or more jobs .
  • To be sumitted from May to October to Tax Office (Agenzia delle Entrate), or to post offices or to fixed banks..
  • You can apply to CAF-CIA.
  • to declare the overall amount of your income to obtain a TAX RETURN in your July’s payroll.
  • Application must be submitted to employer by April, ortherwise by
  • May if submitted to any CAFoffice (Tax Assistence Center).
  • Form’s submission to CAF-CIA’s is free, while the “Form 730” filling in is on payment.

ABOUT INCOME TAXATION: things to know

  • Registration at the Enterprises’ Board
  • Registration at the Social Security (INPS) and payment of the deduction for insurance.

SELF EMPLOYMENT

  • Regularly bookkeeping;
  • Invoincing.

FISCAL DUTIES:

SUBMISSION OF THE “FORM UNICO”

  • Declaration of enterpise’s incomes or incomes earned by a self- made job.
  • Must submit a declaration even though there isn’t any income.
  • Declaration is to be submitted by 31st Oct. to Tax Office also filing it via Internet, otherwise to the post office or to fixed banks.
