  2. The case • Who?- Jane Roe(Norma L. McCorvey ) ; Respondent: Henry Wade • What?- Roe is not able to get an abortion because it is illegal in Texas. • When?- December 13, 1971- January 22, 1973 • Where?- Texas • Why?-Law in Texas that restricted abortion to specific situations. Jane Roe wanted to challenge this claiming that it is the choice of the mother in regards to her rights to privacy protected by the 1st , 4th , 5th , 9th , and 14th amendment.

Lower courts- Supreme court ruling • The Burger Court 1971-1972 • The Texas court ruled that the law violated the Constitution, Wade appealed to the US Supreme Court • Supreme court • Ruled that abortion fell within the right to privacy(recognized in Griswold v. Connecticut) protected by the Fourteenth Amendment. The decision gave a woman total autonomy over the pregnancy during the first trimester and defined different levels of state interest for the second and third trimesters. As a result, the laws of 46 states were affected by the Court's ruling.

  4. Constitutional issues • Roe argued that it violated the right to privacy from state laws which was protected by the 1st, 4th , 5th , 9th, and 14th amendment.

  5. Landmark case • Why does it matter? • This case is still debated and used as reference to decide other cases like it. • Changed legislature in other states aside from Texas • Happened after feminist movements in the 60s
