  1. Workshop BEWAGEntity in charge of Maintenance Brussels, 01st of December 2010 J-M DECHAMPS

  2. Overview • Context • Certification of entity in charge of maintenance • Questions J-M DECHAMPS

  3. 1. Context J-M DECHAMPS

  4. Old system • Wagons P • Registering Railway undertakings (RUs) - Registration of wagons • Operations and maintenance conditions: imposed • (Private) keepers J-M DECHAMPS

  5. Today (1) • Legal aspect = Railway Safety Directive (2004/49 including amendments) • RU is responsible for safe operation • RU keeps under control all risks including maintenance. Maintenance may not be imposed to Keepers RU, keepers and maintainers may be different • Registration by public authority J-M DECHAMPS

  6. Today (2) • Old system is not authorised but ... RU may still impose maintenance. RU controls risks by imposing maintenance. J-M DECHAMPS

  7. Today (3) • RU controls maintenance managed by other entities such as keepers. • Economic nonsense: many keepers and RUs exchange wagons. RUs are not capable to control all keepers or all entities in charge of maintenance for keepers! Solution: certification of entity in charge of maintenance (ECM) J-M DECHAMPS

  8. 2. Certification of entity in charge of maintenance J-M DECHAMPS

  9. Entity in Charge of Maintenance (ECM) • Certification of ECM • Provide assurance to RUs that the ECM is competent • Unique European certification • The European Commission will adopt by end 2010/beginning 2011 an European regulation based on an ERA recommendation. - The European regulation will be presented to the representatives of Member States in December 2010 (RISC) J-M DECHAMPS

  10. ECM regulation (1) Scope • Mandatory for freight wagon ECMs in EU • Voluntary for certification of maintenance suppliers such as maintenance workshops

  11. ECM regulation (2) ECM functions ECM management = supervision and co-ordination of functions Maintenance documentation Removal from – return to service Maintenance workshops 1) ECM Management 2) Maintenance Development 3) Fleet Maintenance Management 4) Maintenance Delivery

  12. ECM Regulation (3) Certification Basis for ECM certificate: Art 7. Certification Scheme Annex III Requirements ECM Management Maintenance Development Fleet Maintenance Management Maintenance Delivery

  13. ECM Regulation (4) Certification of maintenance functions Art 8. Certification Scheme Annex I Principles Annex III Requirements ECM Management Maintenance Development Fleet Maintenance Management Maintenance Delivery

  14. ECM Regulation (5) Certification of maintenance workshops (CMW) = certification of function maintenance delivery

  15. ECM Regulation (6) Relationship between actors • ECM certificate gives presumption of conformity for RU/IM for its safety management system (SMS)  facilitate the award of safety certificate • Provisions for exchange of information based on contract principles.

  16. ECM Regulation (7) • Certification bodies • Chosen by applicant • Sectoral accreditation scheme (EA) • Information to ERA • Information on type/certific. bodies/certificates • ERA shall keep record and make available

  17. ECM Regulation (8) Entry into force • 20 days after publication • 24 months after entry into force: ECM must be certified  spring 2013 • Transition: • MoU certificates-> original validity but limited to 4 years after entry into force • Self declaration->until ECM must be certified

  18. ECM regulation (9) • ECM management function • Generic management processes: leadership, risk assessment, monitoring, organisational learning. • Generic support processes: structure and responsibility, competence management, information, documentation • Operational processes: contracting activities J-M DECHAMPS

  19. ECM regulation (10) • ECM maintenance development function • Identification of activities affecting safety and safety critical components • Compliancy with interoperability rules • Development and continuous update of maintenance file including documentation • Specific application of generic support processes (information, documentation, competence) J-M DECHAMPS

  20. ECM regulation (11) • ECM Fleet maintenance management • Management of contracts with maintenance delivery • Issue the notice to return to operation • Specific application of generic processes (information) • ECM maintenance delivery • Competence • Facilities, equipments and tools • Documentation and information • Issue notice to release to service J-M DECHAMPS

  21. 3. Questions J-M DECHAMPS

  22. Keeper has no ECM. What happens? Registration must contain identification of ECM incomplete registration  the wagon can not be operated! 2) ECM for all wagons? YES, mandatory also for all wagons. Exception: if excluded by the Railway Safety Directive 3) ECM and GCU? No link. ECM is imposed by law, CUU is private contract. J-M DECHAMPS

  23. 4) Need of approved workshop (atelier agréé)? Legally the workshop must be approved by the ECM. Workshops approved by a RU and covered by its safety management system may be accepted as competent by the ECM. J-M DECHAMPS
