  2. Reforming CS - Why? • Condition of building a modern state • To provide appropriate governance to society • To support economic and social development Having a professional, independent and accountable CS as a condition for implementing other major reforms

  3. Main problematic areas… • Current LCS • Salary system • Training policy • Integrity system • HRM tools • Guidance capacity …leading to weak professionalism in CS

  4. Current LCS - problems • Adopted before the Constitution… • Several (non systematic) amendments (gaps, overlaps, fragmented) • Main areas of problems: • Scope: unclear • Rights and Duties, recruitment, promotion, performance appraisal, discipline: vagueness = arbitrariness • Remunerations – unbalanced • The Labour Code ruling part of the CS statute

  5. Scope Scope: unclear • Different legal acts, from different entities • Mixture of political and administrative positions • Lack of consistent criteria to define CS

  6. Rights & Duties, Recruitment, Promotion, Performance appraisal, Discipline • Vagueness of the regulation • Arbitrariness in implementation • Weak guarantees

  7. Remunerations • Non unitary system • Complex (scheme of bonuses) • Room for arbitrariness in defining individual salaries • Low salaries

  8. Training • Confusing roles (MCSD/NAPA) • Lack of consistent needs assessment • Priorities • Funding • Evaluation

  9. Integrity system • Ethics • Corruption • Incompatibilities • Conflicts of interest • Patronage

  10. HRM tools • Recruitment • Job descriptions • Performance appraisal • Discipline • Mobility • Promotion – professional development • Motivation mechanisms

  11. Guidance • At political level: • The President? • The Government? • The Verkhovna Rada? • At administrative level: • The positioning and the role of the MCSD

  12. Recommendations • Clarification of institutional responsibilities • Redesign the role and positioning of the MCSD • Adopt a new LCS • Reform the salary system • Review training policy
