Regional Haze Update • MassDEP published draft Regional Haze SIP in January 2011 • SIP relied on EPA’s draft Transport Rule for Best Available Retrofit Technology (BART) and “167 Stack” power plant reductions • MA not included in EPA’s final Cross-State Air Pollution Rule (CSAPR) signed in July 2011 • MA intends to submit final partial SIP and re-propose BART and 167 Stacks SIP portions
Regional Haze SIP Timing • Proposed consent decree requires EPA to act on MA SIP by 3/15/12 (proposed action) and 7/13/12 (final action). EPA can: • Approve or disapprove SIP • Approve or disapprove SIP in part • Issue a Federal Implementation Plan (FIP) • MassDEP working with EPA to meet these timelines
