ENFORCEMENT REPORT – DEC 2011 • ACTIVITIES COMPLETED IN NOVEMBER • Notices of Violation (NOV): • Voluntary Compliance was obtained for 15 of 30 NOV’S issued for various code violations identified by the Army Corps periodic inspectionson the Feather River west bank levee between Star Bend and Themolito After bay. • This represents a 50% compliance rate. • Board staff held an “All-Hands” repair kick-off meeting in May 2011 • 6 months later the results are improved levees for PL 84-99 re-eligibility • Landowners and LMA ‘s restored slopes, fixed pipes, and removed blockage. • Compliance action • Board Staff obtained State Lands Commission concurrence for the City of West Sacramento to remove a sinking public dock at risk of breakaway. • Board Staff inspectors oversaw the completion of a critical levee repair under the Interstate-5 bridge crossing the Calaveras river in Stockton.

ENFORCEMENT REPORT USACE Periodic Inspection (PI) Compliance: • November 18thUSACE outbrief of the periodic Inspection for the RD 784 levee systems surrounding Olivehurst, Linda , and Plumas Lakes CA. • The system has unacceptable violations and is now inactive for PL 84-99 federal levee repair funding . • The Levee Maintaining Agency is RD 784. • Board Staff is holding enforcement hearings for private violations. • RD 784 will make maintenance repairs to regain eligibility. • RD 784 was complimented for having an effective rodent control program.
ENFORCEMENT REPORT • 3-MONTH FORECAST • Upcoming Board Hearings: • December 2, 2011: Four enforcement hearings for unauthorized encroachments along Feather River Levee in Linda . • January 27, 2011: Protested permit to relocate 53 private fences on State land along the Feather River landside levee toe in Linda, CA. • March, 2011: Potential enforcement of levee toe excavations caused by orchard operations on Feather River Levee in Sutter County.
