Safety Purpose and Philosophy • Purpose - Make all personnel aware of safety requirements • Safety and using safe work practices is a condition of employment and continued work at SunPower! • The key is to THINK before you ACT. • No job is so URGENT that it can not be completed safely. • Ignoring unsafe acts is CONDONING unsafe behavior. • All occupational injuries can be prevented.

Reporting Emergencies/Unsafe Conditions • To report EMERGENCIES (including fire, medical, and chemical spill) - Call the emergency number in Richmond ext.10800 or in San Jose ext.11800. • Provide your name, phone number, your exact location, and a brief description of the situation. Stay on the phone until you are directed to get off. • WHY NOT call 911? If you call from your desk, the emergency responders won’t know your exact location within the building. DO NOT CALL 911. • Report ALL accidents, injuries, and unsafe conditions to your Supervisor within 24 hours. • If you are unsure about a safety problem, notify your Supervisor and/or the key safety contacts listed previously. • For building related issues, email the North American Facilities Helpdesk at fachelpdesk@sunpowercorp.com to create a ticket or call ext.10699 if urgent.

Elements of the Injury & Illness Prevention Program (IIPP) Communications EHS Training Accident Investigation Managing Change Recordkeeping Managers and Supervisors are responsible for their employee’s safety. If your Manager does not know the answer, please seek an EHS or Facilities contact. 8

Hazard Communication Program (Haz Com) Purpose: Provide information in the form of material safety data sheets (MSDS), labeling, employee information/training and hazard recognition about hazardous materials in use at SP. MSDS contain information about these hazardous materials, trade name products, manufacturer information, what hazardous materials are in the products, and the hazards/precautions that must be taken. If you work with hazardous materials or are concerned about your exposure to them, you should contact your supervisor to request additional information. - Employees, visitors or contractors that want more information or access to the MSDS in use in their building should locate the MSDS station or contact the Facilities or EHS contact at their building. 9

Hazard Communications - Labeling • Primary Container Label • Name of chemical • Primary hazard(s) • Manufacturer name and address • Do not remove • Secondary Container Label • Name of chemical • Primary hazard(s) • Used when you transfer from primary container to a squeeze bottle • Labels are required for process equipment, piping systems, primary and secondary containers that contain hazardous materials

Material Safety Data Sheet • Product Identification • Hazardous Ingredients • Physical Data • Fire and Explosion Hazards • Reactivity Hazards • Health Hazards • Safe Handling and Use • Control Measures and PPE MSDS are available in the big yellow binders located in the area of use. **Pregnant employees or employees who are planning a family and work in hazardous environment (i.e., chemical, radiation, etc.) may notify their manager and EH&S for workplace hazard information.

Proposition 65 • Purpose: • Provide warnings to employees and community affected by SP operations about materials know to the State of California to cause cancer or reproductive harm. • Labeling at the entrances to all SP facilities with required warning: “This area/building contains chemicals know to the State of California to cause cancer, birth defects or reproductive harm” - Employees, visitors or contractors that want more information should contact Facilities or EHS contact at their building about chemicals that are present and Proposition 65 listed.

Warning Signs, Tape & Barricades • RED Danger Tape • Do Not Cross – This is a high hazard situation • Only authorized emergency response team or MERT team members may cross. • ORANGE Warning Tape • Indicates a hazardous situation which, if not avoided, could result in death or serious injury. • Do Not Cross • YELLOW Caution Tape • General hazard, CAUTION • Do Not Cross • CHAINS/BARRICADES • Protect workers or equipment from a hazard • Do Not Cross

General Safety Guidelines • Know where MSDSs for your work area are located. • Know the hazards in your area. • ALWAYS use the proper Personal Protective Equipment (PPE). • Know the location of eyewashes/safety showers. • Observe and follow all warning signs. • Leave your work area in a clean and safe condition. • No running or horseplay that may result in injury is allowed. • No bicycle riding in the buildings. • Fire extinguishers or other fire suppression equipment is to be used only if you are trained and it does not present a hazard to you.

  16. What to do in an emergency • Fire Alarm • “high/low warble” sound • Activation: heat/smoke detected, sprinkler flow switch or fire pull station activated. • Toxic Gas Alarm (San Jose Only) • “steady tone” sound • Activates if the MDA toxic gas monitors detect a gas leak, if scrubbed exhaust shuts down, or if a manual pull station is activated. • STOP ALL WORK, IMMEDIATELY WALK to the nearest exit, and IMMEDIATELY proceed to the nearest evacuation assembly area. • Richmond – Along Harbour Way sidewalk, northwest of the front door • San Jose – In the front of the building (east side) • Do not stop or return to get personal belongings.

Emergency Evacuation and Assembly Zones • Know Your Exit Routes! • Evacuation maps are posted • Located at main lobbies and through the building • Know how your building fire alarms sound • Know your Assembly Zones • Participate in the evacuation drill • All Supervisors/Managers are required to take a headcount of their respective employees. • Employees and contractors are required to stay at their designated relocation area until a headcount can be performed by their Supervisor/Manager. • Headcounts shall be given to the appropriate emergency personnel upon request.

Emergency Alarm in Richmond Only Community Emergency Alarm Every Wednesday, Contra Costa County’s Community Awareness & Emergency Response (CAER) Community Warning System (CWS) is tested between 10:00 – 11:00 am.  Sirens have been placed in the industrial corridor of the county and are intended to be used for chemical accidents. During these tests the alarm is activated. You do not need to take action.  Please continue working as normal.  20

  21. Shelter, Shut & Listen If it is a real Community Emergency Alarm Stay inside the building. Close all windows and secure doors. Facilities will turn off all ventilation systems such as heating or air conditioning. If you see gaps in windows or doors, seal with tape or damp towels. Have an AM radio for emergencies and tune it to KCBS 740 for more information 21

  22. Earthquakes • Take cover in a doorway, under a sturdy desk/table, or against a wall that doesn’t have overhead hazards until the shaking has stopped. Then quickly evacuate to your Assembly Area. • Stay away from glass windows, overhead power lines or areas utilizing chemical, physical or electrical hazards.

  23. Medical Emergencies-Treatment & Transportation of Injured Non-emergency medical transport will be provided by pre-arranged cab service. Contact the Building Lobby Receptionist for assistance during normal hours or Contact Security during off-hours. Employees, supervisors, and co-workers are not allowed to transport injured personnel for liability reasons and Cal/OSHA regulations. Emergency medical transport will be summoned by calling the emergency phone numbers. SunPower representative will met the 911 Responder and direct them to the appropriate location. 23

Emergency Equipment • Fire equipment, including building sprinkler riser valves, are not to be used, moved, or blocked, unless specific written approval is first obtained from site EHS. • Portable fire extinguishers, first aid equipment, eyewash stations, and Emergency deluge showers are not to be moved, turned-off, removed, or blocked without the written permission of EHS. • Contractors will be responsible for providing their own safety equipment required by the job or task.

  26. Ergonomics “The interface between the worker and the work environment” • Report any symptoms of repetitive motion injuries to your Supervisor when they are initially felt. • Ergonomic injuries can be successfully addressed with early reporting of symptoms and ergonomic stressor intervention. • For an evaluation, please open a Facilities Helpdesk Ticket in Outlook.

  27. Management of Change Policy • Chemical Approval – all new chemical purchases are reviewed & approved after review of the MSDS, and consultation with Facilities/EHS Representative at your site. • New Tools & Equipment – all new tools/equipment that have safety, health or environmental hazards are reviewed & approved after review of the product information, and consultation with Facilities/EHS Representative at your site. • New Process Reviews – all new processes or significant process modifications that involve safety, health or environmental hazards are reviewed & approved after review of the process change information, and consultation with Facilities/EHS Representative at your site.

EHS Training • Ask your Supervisor or EHS contact if you are required to take additional EHS Training classes, such as: • Hazard Communications High Hazards – San Jose Labs & Chemical Users • Hazardous Waste Handlers – San Jose Labs & Techs • Forklift/Powered Pallet Jack/Aerial Lifts – Richmond Users • Medical ERT/Emergency Response Team (ERT) – Members • Fall Protection/Elevated Work Locations – Affected Employees • Noise Exposure – Richmond Routing, Cement Mixing, Shop Tools Users • Respiratory Protection – Chemical Handlers, Routing, Cement Mixing

Environmental Policy – Authorized by Tom Werner, CEO Environmental Management System Policy states: SunPower is committed to conducting business in a manner that promotes a safe, clean, and “Green” Environment. To support this effort, SunPower will: • Comply with all applicable environmental laws, regulations and other requirements that may apply • Continually review and improve its environmental system and control • Continually improve its environmental programs and the prevention of pollution that may result from business activities • Set targets and objectives in order to conserve natural resources, minimize waste, and provide an environmentally friendly workplace.

Environmental Programs • Recycling Partner is FRG Waste Resources, Inc. • In the kitchens and printer stations, there are 3 types of bins: Trash, Cans/Bottles, and Mixed Recycling. • The Coffee/Tea bins are part of an employee run program. Sign up on the list in the kitchen and take the grounds home for your garden. • At your desk there are 2 types of bins: Trash and Shred/Paper Only. • Shred/Paper Only – Everything in these bins will get shredded. Please do not include food waste or other non-shreddible items. • Cans/Bottles should NOT be thrown into desk bins. Take them to the nearest printer productivity station or the nearest kitchen where you will find Cans/Bottles recycling bins. • Spent batteries are collected in the lobby.
