  1. Mongillo Law - Collaborative Law And Its Advantages

  2. Divorce or separation is difficult for a couple and the family. Nobody wants to tell the whole world about their personal lives. Dragging one’s spouse to the court must be the last option. People try and work things out between themselves and reach an agreement about alimony, child support, etc. Lawsuits are expensive and time taking. One must avoid going to court if both parties agree to settle things mutually. Collaborative law promotes the cooperative method to solve legal problems.

  3. Both parties benefit from it as they can solve the issues amicably. Collaborative law involves the two parties and their respective lawyers. A third party like a mental healthcare practitioner or financial expert acts as a neutral third party. They guide the parties and their lawyers to work together to reach a solution beneficial to both partners. A family law firm Like Mongillo Law who works with the family will ensure that his client gets the best out of the situation. You can check  Mongillo Law – The Roles and Responsibilities of a Family Lawyerfor more.

  4. Types of Collaborative law: Negotiation - Negotiation is a type of collaborative law. The two parties sit with their attorneys and discuss the issues. The issues arise when the partners decide to get divorced or separated. The attorneys work together and reach a solution beneficial for both parties.  Mediation - During mediation, a neutral third party solves the dispute in favor of both parties. The mediator is an expert in the field of discussion among the partners.

  5. Advantages of Collaborative Law: Exercise Control - The parties working together have the chance to argue about the outcome. The parties have control over the results. When the court is involved, its order is final and non-negotiable. The parties have to accept the decision without any question. Child Custody - Parents who opt for collaborative law learn to work together to care for their children. A child needs both parents while growing up. If the court grants sole custody, the child will not be able to spend enough time with the other parent. Co-parenting helps in the overall physical and mental development of a child.

  6. More efficient - Court proceedings take a long time, and the partners have to be present in court when the court requires. Collaborative law solves the problem in a shorter time as the partners work together. The lawyers work around the schedules of both parties and are flexible with the duration spent in each sitting. The parties do not have to miss work to be present at the meeting.  Less Stressful - Getting divorced is physically and mentally exhausting. Collaborative law uses a more informal method of resolving issues. They can argue and discuss till they reach a mutual understanding.

  7. Private - Screaming personal details of one’s marriage is embarrassing. If the parties go to court, all the sensitive information about their married life gets discussed in public. Collaborative law allows the parties to talk in a more private setting with only the lawyers present. The details do not become a part of public records. Supportive - The court passes judgments according to the written and implied laws. It does not care about the unique circumstances of each case. In collaborative law, the couples feel more supported as they have the right to put forth their views on each point of discussion.
