  3. The previous OHS-system • OHS-affiliation is an obligation for companies in some lines of trade - covering 40% of the labour market • Strong governmental quality-control and high demands on OHS-education • Worker-participation is ensured in OHS-ma-nagement and in executing of the OHS-tasks

The new OHS-system • The labour-inspection will order OHS to com-panies breaking specified H&S-rules • The OHS must have an authorization • The OHS-advisory will not be quantified and looks like a kind of privatized control • Neither labour-inspection nor OHS-orders to companies with an H&S-certification

  5. Change in OHS-qualifications The previous OHS-system: • Every OHS-consultant must deal with educati-onal demands • The OHS-unit must document the advisory quality according to three demands The new OHS-system: • Only key-consultants must have some rele-vant experience

Two sorts of OHS Two different sorts of OHS-advisory: • Advisory ordered by the labour-inspection • Optional and market-based advisory …is it possible to combine these two sorts of OHS? …and how big will the interest of the employers be for optional H&S-advisory be - in Denmark they are free to fire juried employees

The political background • The old OHS-system was un-equal to diffe-rent lines of trade at the labour-market • Unfair that also good companies had OHS- obligations • The old OHS-system gave the safety commit-tees power to increase work-environment re-gardless the level of the H&S-regulation • Good companies who observe the H&S-rules must be free of governmental demands

From reflexive to normative, rule-based regulation The new OHS-system • implies that an exact regulation of all kind of H&S-problems is possible – e.g. TLV • is a tool for the employer to solve out pointed problems to observe the rules in the H&S-act • is not a tool for the development of in-plant H&S-cooperation about H&S-prevention • the labour-inspector defines the OHS-tasks – not the in-plant social partners

  9. The future of Danish OHS? • The Danish OHS-system accept these politi-cal changes as a challenging framework for the further development of the OHS-system ..but we must worry very much about e.g. • The continuous, company-based prevention • The work-environment in all the companies who have neither a very good nor bad H&S • The OHS-quality and -impartiality • The workers-participation and in-plant coope-ration
