  2. The Main Idea of Article I Article I defines Congress and summarizes the Legislative branch’s powers, restrictions and rules. It also declares what the states cannot do.

  3. The Most Important Clause • Section 8, Clause 18 • AKA The Elastic Clause • There are different opinions of necessary and proper so it “stretches” what congress has the powers to do • Many debates today are over different interpretations of this clause

Constitutional Principles Part 1 • Section 1 – Describes Separation of Powers by telling the powers granted to Congress • Section 2 – Is Republicanism because it talks on how the people will vote for the members of the House of Representatives  • Section 3- Describes Separation of powers, saying that there will be a president that has a term of four years • Section 4- Describes Federalism and Republicanism, stating that each year elections for senators and representatives will be held in different places unless it is changed by congress • Section 5- Checks and Balances because each branch will check the others to ensure all branches obey the law. Each branch will have the power to punish members if a law is broken • Section 6- Federalism because a senator or representatives can not get arrested on the way to a meeting or back, but if they comment treason felony and breach of the peace they will be arrested

Constitutional Principles Part 2 • Section 7: Describes the Checks and Balances between the Legislative Branch and the Executive Branch. “In order for a bill to become a law, the bill shall first be passed by both houses of Congress, which is then sent to the President. The president has the right to veto the bill, but Congress has the right to override the veto if two-thirds of the congress decide to override it. The bill must be returned to Congress within 10 days (except Sundays) or else it becomes a law. Like-wise, it will not become a law if Congress is not available to receive the bill back from the president.” • “Every bill which shall have passed the House of Representatives and the Senate, shall, before it become a law, be presented to the President of the United States: if he approve he shall sign it, but if not he shall return it, with his objections to that House in which it shall have originated…” • Section 8 and 9: Describes the Separation of Powers by the Legislative Branchby stating the powers granted and denied to Congress. • “To borrow Money on the credit of the United States;” • “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” • Section 10: Describes Federalism because powers are denied to the States. States are not allowed to lay taxes, or keep troops or ships of war in time of peace without the consent of Congress. • “No state shall enter in any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emits Bills of Credit…” • “No state shall, without the Consent of the Congress, law any imposts or duties on imports or exports, except what may be absolutely necessary for executing its inspection laws…” • “No state shall, without the Consent of the Congress, law any Duty of Tonnage, keep troops, or ships of war in time of peace, enter into any agreement of compact with another state, foreign power, or engage in war, unless actually invaded, or such imminent danger…”
