Prevention : • Distribution of newsletters and info on website where it should be easily accessible • Promotion of the role of the President as an ally in the exercise of your professional activity The lawyer who wants to do something, can ask his/her President who will : • verify whether the proposed action is admissible in the light of professional rules & • give advice to the lawyer & • look together with the lawyer for a compliant way of achieving the lawyer’s goals • In certain cases lobby to amend the rules in order to reconcile the lawyer’s proposed activity with the fundamental principles Prevention and Disciplinary Sanctioning at the Brussels Bar

Therefore the lawyer him/herself will address the President : • This is voluntary but recommended if any doubts about compliance (examples) • Mandatory in case of • scope of the profession (New) • seconded lawyers in the company (offices) of a client • use of confidential correspondence in procedures (exceptional) • agreements to work together (with lawyers and non-lawyers) • issuing a writ or complaint against lawyers, bailiffs, notaries, magistrates • being subjected to a seizure, writ or judicial complaint Prevention and Disciplinary Sanctioning at the Brussels Bar

Mediation of the President of the Bar: People (lawyers or other) address the President about a problem which is not necessarily a breach of the Ethical Rules; i.e. • Disagreement between partners or associates in a Firm • Fees (this will be transferred to a commission : success rate = +/- 75 %) • Communication problems between client and lawyer or non transmission of documents to the colleague who took over a case (this can be the indication the lawyer has a problem in which the Bar can help (the bar has a minimum income insurance, can delegate someone for temporarily support or have a Tutor appointed (seldom)) • Incidents at hearings • All non formal complaints/demands for intervention where the main interest of the client is that the problem gets solved Prevention and Disciplinary Sanctioning at the Brussels Bar

Provisional and protective measures: People (lawyers or other) address the Presidentabout a specific application of the Ethical Rules; i.e. • Informal decision of the President of Bar (prepared by his/her cabinet) • A question is raised by a Party – this is transmitted to the other Party for remarks - these remarks are transferred to the first Party for further remarks and accompanied by a first analysis – another round of remarks and the decision is taken. The parties could be heard if desired. • The compliance with these decisions is 99,9% Prevention and Disciplinary Sanctioning at the Brussels Bar

Provisional and protective measures (next): • Injunctions by the President of the Bar • This is a more formal decision of the President (formal motivation, operative part …) • Against these decisions proceedings before the ordinary courts would be possible (very rare) as a sort of second instance • Non respect of an injunction (or an informal decision) is an infringement of the Ethics Code Prevention and Disciplinary Sanctioning at the Brussels Bar

Provisional and protective measures (next): • “Court Ban” (seldom) • = A prohibition to be present at the courts, tribunals or any judicial instance • The lawyer has the right to be heard and has the possibility to present his defence • The decision is taken by the President of the Bar and has to contain a motivation – max period is 3 months • Possibility to prolong by the Council (same period) with possibility to be heard • Second instance before Disciplinary Court of Appeal Prevention and Disciplinary Sanctioning at the Brussels Bar

Provisional and protective measures (next): • Paternal/Maternal admonition – Mention in the personal file • The lawyer has the right to be heard and has the possibility to present his defence • The President, who is the only person who has the possibility to open a disciplinary investigation (see later), estimates the infringement is proven (mainly because of a confession) but it is not necessary to open an investigation (// Prosecutor = opportunity) Prevention and Disciplinary Sanctioning at the Brussels Bar

Disciplinary procedure: • President will normally appoint a rapporteur (can also do the investigation himself) by letter send to lawyer concerned • The letter will enumerate the investigated infringements and the measures the rapporteur can take in order to reveal the truth • The rapporteur hears the plaintiff if he/she asks for it and the lawyer concerned. He/she can take all the measures enumerated in his appointment letter to reveal the truth • He/she draws up a report with a proposal to the President as to the steps to take Prevention and Disciplinary Sanctioning at the Brussels Bar

Disciplinary procedure (next): • The president can take the following decisions : • The infringement is not proven or the facts were not an infringement of the Ethical Code • The infringement is proven, but it is not heavy enough to send the case to the Disciplinary Board (in this case (s)he can issue a Paternal/maternal admonition) • The infringement seems proven and he sends the case to the Disciplinary Board Prevention and Disciplinary Sanctioning at the Brussels Bar

Disciplinary procedure (next) : • In case of inaction of the President or if the plaintiff doesn’t agree with the decision of the President he can seize the President of the Disciplinary Court who will investigate if the decision of the President of the Bar was justified and if not, he can bring the case himself before the Disciplinary Court (in which he will not sit) • The Disciplinary Court (all Lawyers) can take decisions from a warning, a reprimand, a suspension or a removal. These sentences can be conditional. • Appeal is possible at the Disciplinary Court of Appeal (presided by a magistrate in the court of Appeal and in the Presence of the Prosecutor near the Court of Appeal) • Non-factual/legalistic grievances against the decision of the Disciplinary Court of Appeal, can be taken to the “Cour de Cassation” (Supreme Court).   16. Some figures : Prevention and Disciplinary Sanctioning at the Brussels Bar Since 2016 the ombudsperson Ligeca also deals with grievances of clients and lawyers. (about 50 files/year)
