PUBLIC BENEVOLENT COLLECTIONS The Charities and Trustee Investment (Scotland) Act 2005 S84-92
Current Legislation • S119 Civic Government (Scotland) Act 1982 • Public Charitable Collections (Scotland) Regulations 1984 (as amended) • Public Charitable Collections (Scotland) Regulations 1988
Current Requirements • Local Authority licensing led regime – called PCCs • Must apply at least 1 month prior to collection date • Must submit accounts within 1month of collection end date
Why change? • PCCs are public face of charities and fundraising • Maintain public confidence • Include new methods of fundraising which did not exist in 1982 eg direct debit sign ups
What will change? • New name – Public Benevolent Collections (PBCs) - includes collections for benevolent purposes (wider than charitable purposes) • Public place – will include any place to which the public have unrestricted access • supermarket car parks • shopping malls • Direct debit sign ups will need to apply to LAs for a licence
OSCR Role • Monitoring, advisory • Local Authorities, Charities and Fundraisers • Exempt Promoter Scheme • replace with Recognised National Collectors • Promote good practice/consistency of approach
Goods CollectionsProposals • Organiser to notify LA of proposal to carry out a collection • LA can, under such circumstances specified in the regs, refuse a collection • Dates, times, places and frequency of collections • Keeping and publishing report on collections • Preventing public inconvenience
How ? • Engage with stakeholders, eg, LAs, charities, OSCR, SCVO, IoF • Value their views and ideas • Consult on proposals • Consult on draft regs
When will the changes happen? • Currently engaging with stakeholders • Consult on proposals • Consult on draft regs • New legislation 2012 – subject to the will of Parliament
