Duty of a Labor Compliance Program “A Labor Compliance Program shall have a duty to the Director (of DIR) to enforce the requirements of Chapter 1 of Part 7 of Division 2 of the Labor Code and these regulations in accordance with the precedential prevailing wage decisions issued by the Director and in a manner consistent with the practice of the Labor Commissioner.” (8 California Code of Regulations 16434) 2/8

SDCCD Prevailing Wage Resolution Language • Whereas, The board further determines to establish and enforce a labor compliance program for projects funded by the proceeds of a general obligation bond which includes requirements relating to the payment of prevailing wages and compliance with all applicable state and federal labor and public contract laws • Not a DIR Approved LCP Program 3/8

Role of the LCP on SDCCD Projects • Attend Pre-Con to educate Contractors on Prevailing Wage Requirements • LCP Tracker Set up and Education • Assist Contractors with LCP Questions Throughout Project • Monitor Payrolls and Ancillary Documents • Perform Audits/Investigations in Conjunction with the DIR/DLSE • Site Interviews/Visits • Closeout of Project 4/8
