  5. Proposed Gregory Canyon LF Consideration of a proposed action for a new Solid Waste Facility Permit for the Gregory Canyon Landfill

  6. Purpose of Meeting • An opportunity for interested parties to provide comments • An overview of the solid waste facility permitting process • The role of CalRecycle • Provide a summary of the proposed project

  7. Purpose of Meeting • No decision regarding the proposed permit will be made at this meeting • CalRecycle staff will consider comments within our purview • A transcript of the meeting will be generated

Solid Waste Facilities Permits Required by State Law: • Permit required to operate a solid waste facility • Issued to the facility operator • Design and operation only as authorized in the permit • Can not contain conditions pertaining solely to air or water quality • Significant changes authorized only through permit revisions

Proposed Permit Action • The Local Enforcement Agency (LEA), San Diego County Dept. of Environmental Health determined the permit application was complete & correct on February 1, 2011. • CalRecycle received the proposed permit on May 16, 2011. • CalRecycle must take action no later than July 15, 2011.

Proposed Permit Allowances • Maximum traffic - 675 vehicles per day • Design specifications: • Total Area – 308 acres • Disposal Area – 183 acres • Design Capacity – 57,000,000 cubic yards • Maximum Elevation – 1,100 feet above mean sea level • Maximum Depth - 380 feet above mean sea level • Estimated closure date – 2040

  11. Proposed Permit Allowances • Municipal solid waste sanitary landfill • Days and hours of waste receipt: • Monday - Friday, 7:00 am to 6:00 pm • Saturday, 8:00 am to 5:00 pm • Tonnage: • a peak daily tonnage of 5,000 tons per day • a maximum of 1,000,000 tons per year

  12. Proposed Permit Allowances • California Environmental Quality Act (CEQA) Mitigation and Monitoring Program and project design features are included & will be enforced through the permit

  13. CalRecycle Staff Independent Review • Consistent with and is supported by CEQA analysis

CEQA • CEQA applies to CalRecycle’s decision on the proposed Landfill • Under CEQA, CalRecycle is a “Responsible Agency”; the LEA is the “Lead Agency” • The Lead Agency prepares the EIR for the project • A Responsible Agency must use the Lead Agency’s Environmental Impact Report except in unusual circumstances (such as the project changes before the Responsible Agency acts on it or new information is learned) • A Responsible Agency can impose mitigation measures only on matters within its jurisdiction

CalRecycle Staff Independent Review • Consistent with State Law and Regulations • Conforms with the Countywide Integrated Waste Management Plan • Preliminary Closure/Postclosure Maintenance Plans consistent with state minimum standards • Current documentation of acceptable funding level for Financial Assurances • Current documentation of compliance with Operating Liability Requirements

  16. CalRecycle Review • Staff reviews application package submitted by the LEA and provides a staff report and findings to management. • CalRecycle must concur or object to proposed permit within 60 days after LEA submits permit (July 15, 2011). • If CalRecycle concurs, the LEA will be required to issue permit.

  17. CalRecycle’s Role • CalRecycle must concur unless the permit fails to meet statutory requirements, such as: • Permit is not consistent with state minimum standards • Financial assurances for operating liability are inadequate • Financial ability to provide for closure/postclosure is inadequate

  19. Next Steps • Information as it becomes available will be posted on the CalRecycle’s website at: http://www.calrecycle.ca.gov/Actions/PublicNoticeDetail.aspx?id=436&aiid=423 • Staff Report will be posted for at least 5 days before CalRecycle action.
