The Small Business Administration’s 8(a) program, named for a section of the Small Business Act, is a business development program created to help small disadvantaged businesses compete in the American economy and access the federal procurement market. The SBA 8(a) program is designed to benefit the client as well as the contractor by: Allowing small disadvantaged companies the ability to pursue sole-source procurements, Allowing federal agencies the ability to offer “8(a) only” competitive bid procurements, and Ensuring that the 8(a) company is stable and able to handle the workload - SBA does an extensive background check on the company prior to giving it an 8(a) designations Through sole source contracts, businesses are given an opportunity to enter the government-contracting arena and gain the experience necessary to compete in the full and open market. 8(a) Overview

    16. Alaskan Native 8(a) Advantages Firms that are 51% or more owned and controlled by ANC’s are deemed socially and economically disadvantaged by statute. The SBA is required to waive the two-year-in-business rule for tribal and ANC-owned firms so long as the SBA finds that the firm has a marketing and development strategy for meeting the competitive mix of requirement of the 8(a) program. As a result, a tribal or ANC 8(a) firm may be a start-up that is teaming with a more experienced firm in the beginning. The CEO of a tribal firm must be a member of an economically disadvantaged tribe, but he or she does not have to demonstrate personal social or economic disadvantage. There are no qualifications or requirements of any kind for the CEO of an ANC. OMB Circular A76 stipulates that the government may avert the process of conducting an A76 study and directly outsource non-inherently governmental functions of any scope, directly to a tribal or ANC 8a entity.
