  11. Criteria for Granting Variances Chapter 405, Section 405.40 • Special conditions and circumstances exist which are peculiar to the land, such as size, shape or topography, which are not applicable to other lands in the protected area; • The special conditions and circumstances do not result from the actions of the applicant; • The variance, if granted, is the minimum variance that will make possible the reasonable use of the land, building, or structure; and • The variance is necessary to promote public safety.

  12. Recommendation • Approve the resolution authorizing a variance to the Scenic Road Corridors Overlay to allow a shed within the 100’ protection area setback at 1709 SW 49thPlace.
