  3. PIRACY - Somalia • 2010 Statistics (IMB) - 219 attempted incidents - 49 hijackings (21% of incidents) • 2011 Statistics - 237 attempted incidents - 28 hijackings (11% of incidents)

PIRACY - Somalia • 2012 Statistics (March 8) - 31 attempted incidents - 6 hijackings (21% of incidents) • 2012 Statistics (June 25) - 67 attempted incidents - 13 hijackings (19% of incidents) (4 dhows & 3 fishing vessels) • 2012 Statistics (September 24) - 70 attempted incidents - 13 hijackings (18% of incidents)

INTERTANKO position regarding the use of armed guards • INTERTANKO believes it is the responsibility of the international navies to ensure the right of free passage on the high seas including the use of vessel protection detachments on merchant ships • INTERTANKO does not advocate the arming ships' crews • INTERTANKO believes that the use of private armed guards or private security forces onboard merchant ships has to be a matter for each individual owner or manager to assess as part of their own voyage risk assessment

IMO IMO Maritime Safety Committee • MSC.1/Circ.1405 – Interim Guidance to Shipowners, Ship Operators and Ship Masters on the use of Privately Contracted Armed Security Personnel on Board Ships in the High Risk Area • MSC.1/Circ.1406 – Interim Recommendations for Flag States regarding the use of Privately Contracted Armed Security Personnel on Board Ships in the High Risk Area • MSC.1/Circ.1408 – Interim Recommendations for Port and Coastal States regarding the use of Privately Contracted Armed Security Personnel on Board Ships in the High Risk Area

IMO IMO Maritime Safety Committee • MSC.1/Circ.1443 – Interim guidance to private maritime security companies providing privately contracted armed security personnel on board ships in the High Risk Area • MSC.1/Circ.1444 – Interim guidance for flag States on measures to prevent and mitigate Somalia-based piracy (compilation, in a single reference document, the best practices, codes and standards developed by IMO to date)

ISO • IMO MSC requests ISO to develop standard for guidelines and the certification of private maritime security companies providing PCASP • Standard to be based upon MSC.1/Circ.1443 – Interim guidance to private maritime security companies • ISO Publicly Available Specification (PAS) 28007 developed and out for balloting • Expected to be made available to IMO MSC 91 meeting November 26-30

  12. GUARDCON • Contract for the employment of security guards on vessels • Developed by BIMCO to provide clearly worded and comprehensive standard contract to conclude agreements with security services • Reviewed by INTERTANKO Documentary Committee and endorsed for use by members

Rules on Use of Force (RUF) • BIMCO Guidance on Rules for the Use of Force (RUF) by Privately Contracted Armed Security Personnel (PCASP) • adopted after significant consultation with broad industry, insurance and legal sectors • supplements GUARDCON • 100 Series Rules - An International Benchmark for Commercial Maritime Rules for the Use of Force (RUF) • developed UK attorney • intended to supplement ISO PAS 28007

  14. Risk Assessment • BMP4 Section 3 recommends ship operators carry out thorough risk assessment • Industry associations have received requests for assistance from members • Seeking RT/OCIMF agreed joint approach • Most contentious issue within the RA is speed

High Risk Area (HRA) • BMP4 which is an industry document defines High Risk Area • Egypt wants Red Sea excluded • India wants HRA moved further away from Indian coast • UN Contact Group on Piracy off the Coast of Somalia has requested WG 3 to consider a review of the HRA through discussions with industry

Ransom Payments • UK creates international Task Force - “the ultimate goal is to arrive at a position whereby pirates are no longer able to profit from ransom payments” • Industry Advisory Panel established to provide industry input to TF • Lead by INTERTANKO, industry input has focused on ensuring that TF recommendations do not to interfere in any way with our members ability to pay ransoms

  17. West Coast of Africa • Piracy off the west coast of Africa is worsening • The model is for ships to be taken, barges filled with cargo then ships released. However these pirates are very violent • New name – Extended Duration Robbery (EDR) • UK Foreign Office and OCIMF working together on launching a co-ordination center in the region • Executive Committee requested Secretariat to develop guidance for Members specific to the piracy problem in West Africa.

NATO Guidance New NATO issued guidance: • Identification guide for Dhows, Skiffs and Whalers in the High Risk Area • Dhow and Skiff Recognition Chart • Yemeni Fishing Template • Objective: • Assist bridge team in identifying vessels • Assist military in improved reporting of vessels • Guidance issued in INTERTANKO Weekly News No. 41/2012
