The need for adoption of new law The lack of integrated water management approach in legislation and in practiceInappropriate and ineffective institutional setupFulfillment of international obligationsFramework Lawon waters– regulates the basic principles, general standards and requirements and sets consistent and sustainable strategy and water resources development policy. Creates legal basis for determination of technical standards, quantity and quality values.

  4. Use of waters • Fundamental subject of protection- water regime • Common use of waters and use on a basis of permits (water rights). The latter replace the existing system of water-economy permits and water- economy consents • The water rights procedure is a subsidiary procedure. The environmental permitting is primary procedure. • Concessions • New - public participation in the decision making process

Planning Basic strategic and planning documents: • National Strategy for waters(aim: to set long- term policy for sustainable development in area of water management in Macedonia) • Water Master Plan (existing planning document with new function- integrated water management on national level as general document unifying the needs of all river basins) • River Basin Management Plans (result of the changes in the general management approach- planning of the integrated management on a river basin districts basis. These are basis for issuing permits). New: Public participation in the planning process

Protection of waters • New Approach-integration of the water protection policy in the overall water management policy • Pollution of water shall be PROHIBITED Exception - only if permitted by competent authority under strict conditions stipulated in a permit in accordance with the RBMP • Initial assessment • Setting Environmental objectives • Programme of measures (basic and additional) • Pollution control and combined approach • Water protection zones and sensitive zones (water intended for human consumption, bathing waters, nitrate sensitive zones, waste water sensitive zones; nature protected areas)

Monitoring and Data Management • New: Monitoring on the quality and quantity of all water bodies: • Water intended for use (waters in system) • Water in natural state • Self- monitoring • New : Data management system • New : Access to information, obligation for active and passive dissemination of information)

  8. Information system • Water book as register of issued permits- New: data, content andpurpose of the water book • Cadastre of water polluters • Access to information

Protection from adverse effects of waters • Protection from adverseeffects are measures and activities for: • Flood defense • Protection from erosion and droughts, • Surface water bodies ice protection, • Mitigation of the negative consequences • Competences for protection from adverse effects of waters (RBMB) • Programme for protection from adverse effects of waters- part of the RBMP

  10. Water Management works and services • New: Standards and obligations for maintenance of water management structures and facilities • New : Right to disconnect user • New : Water management works approval

Finnancing • Price of the Service: • Water use/discharge fee (Cost recovery principle) • Environmental costs and • Costs of the resource in accordance with the polluter pays principle • Financial sources: • Fees (for use of waters, for discharging; for extraction of sand gravel and stone ); • Contribution for waters (as Para fiscal tax); • Budget of Republic of Macedonia and the LSG units); • Other incomes
