  1. Guide to Guardianship

  2. WHAT IS GUARDIANSHIP A legal guardian is an adult who is chosen by a court or a dependent's will to make decisions on behalf of an individual who cannot make decisions for him or herself, usually a minor but sometimes an adult with special needs.

  3. WHAT DOES GUARDIANSHIP DO It allows parents to name a caregiver and to give the caregiver certain legal rights regarding the care of the child. It is really important to hire the right guardianship lawyer.

  4. MAIN REASONS TO SET UP A GUARDIANSHIP 1. A minor child's parents are deceased. 2. An adult has become mentally incapacitated or incompetent. 3. An adult is functioning with diminished capacity in some area.

  5. NOT TO MAKE THESE 5 COMMON MISTAKES: 1. Not thinking long-term 2. Not providing detailed instructions on how your children should be raised 3. Naming only 1 guardian 4. Not specifying who you don’t want raising your children 5. Choosing a specific person just to appease them

  6. Factors to Consider When Naming a Guardian for Your Minor Children • Parenting Skills • Location & Living Situation • Religious & Moral Beliefs • Stable Job & Financial Situation • Age & Stage of Life
