I am unable to help him and do not know what else to do. I am afraid without your help my brother will be lost forever. Here, a miscarriage of justice is being done to my brother by the justice system. The court made a clerical error, because of that error he was sent to Coalinga State Hospital, a maximum security facility for those who have been convicted of a sexually violent offense. Ruben is the only one in the hospital who has never committed a sexually violent offense, nor has he ever been convicted of any sexually violent offense. While Ruben has been at the Hospital, the court was made aware of this error. The court corrected the error. Since the court corrected the error, logic would dictate Ruben would be released. However, the court holding Ruben has ignored the law and the Constitution with impunity, and this is not right. I do not know where to turn to find help for my brother. He remains in limbo with no hope in sight. Please help me bring my brother home. Thank you for your valuable time and consideration.   8. As can be seen in this copy of the reporter’s transcript, the prosecuting attorney herself specifically uses this term: non-forcible to describe my brother’s charges. In doing so, she effectively removed the issue of force from the equation. Page 8 of 18

  9. This is the first thing that started this whole mess… Here, a month later, the court clerk put the complete opposite: forcible sex offenses, making everyone think he had been convicted of forcible sex offenses, which is clearly not the case. Page 9 of 18

  10. The court clerk erroneously listed my brother’s convictions as forcible, thereby setting in motion this chain of events that has left my entire family desperately trying to get Ruben back. Page 10 of 18

  11. Here, four years later, the Abstract of Judgement was ultimately corrected, showing that Ruben did not commit any forcible act. My brother should have been released the very same day… …but because he is uneducated, and does not have the resources to seek help, Ruben remains unlawfully detained. Page 11 of 18

  13. Here, an ex-priest did not plead guilty to any sexually violent offense, and neither did my brother. Page 13 of 18

  15. Here, another four years later, the federal court stated that my brother’s plea agreement included only sex crimes that were non-forcible, but still refused to help. It is a proven fact by the federal court that my brother has only non-forcible sex offenses. What is clear is that my brother is being wronged by the justice system. All sex offenses are not the same. The difference between • forcible and non-forcible sex offenses is as clear as night and day or alive and dead, male and female; they are complete opposites! Now, if they change the law and say that all sex offenses are going to be deemed forcible, then you can do this to my brother. And just as the ex-priest was released for non-forcible sex offenses, so should my brother be released. My brother was promised statutory rape with a prostitute. • Here, show me and my family where my brother admitted to anything forcible, or was found guilty of anything forcible. • This is a prime example of the kind of abuse and lack of justice which had • people fleeing in droves from western Europe a couple hundred years ago. My family is a good family; we still want to believe in the Justice System; we still want to believe in what is fair and honorable. We all make mistakes when we are youngMalicious prosecution and false imprisonment is what we have here. The bottom line is that he doesn’t have anything forcible, and this is not right.
