The aims of the presentation • To give a short overview of the existing procedure; • To draw a vision of a future unified system; • To show steps for improving the data flow between the Cadastre and Land Book for simplification of the property registration process before the introduction of the unified system.

Step 1 Registration of the real estate in the Cadastre Register text and spatial data (technical characteristics and ownership information) on real estate as a set of objects, as well as on objects (land parcel and building); Register on the basis of the written request of the owner; Necessary data is collected in the process of cadastral survey.

Step 1 Registration of the real estate in the Cadastre (2) After the registration of data is completed the following documents returned to the owner for submission to the Land Register: Plan of the land boundaries with the stamp proving the registration in case of land parcel; SLS statementregarding the connection of the buildings (structures) with the land.

  7. Step 2 Registration of the property rights in the Land Register Register text data on the ownership and related property rights (e.g. prohibitions and encumbrances); Register on the basis of the request for the corroboration (notarially prepared) and attached documents.

Flow of the electronical data between the Cadastre and Land Register The Cadastre receives automatic updates of the ownership data (only owner); Land Register officials view Cadastre data online for the completion of the registration procedure of the property rights. The addresses and cadastre numbers updates automatically.

  10. Historical aspects and considerations for the existing procedures Land Register is established in 1937 as a paper book, renewed in 1993 without any substantial changes; Land Register belongs to the court system, Land Register officials are judges; Land Register is publically reliable.

Identified problems The process of property registration is complicated, long, owner not-friendly; Complicated procedures require large human and financial resources at the bothinstitutions; Data overlaps in the informational systems and archives; Data differences. In 2007 State Land Service for the first time has proposed to develop unified system for property registration, unfortunatelypolitically not supported. The rapid development of the real estate market and construction business (2004 – 2007) clearly identified the existing problems of the property registration procedures:

  13. Strong division of competence between the State Land Service and the Land Register: SLS is responsible for the registration and keeping of technical data of the objects; LR is responsible for the registration and keeping records of property rights and related rights.

The vision of the future unified system • The Ministry of Justice has established a working group on the development of the unified system for the registration of property. • The Ministry of Justice in close cooperation with the State Land Service and Land Register has started work on the development of the procedures for unified property registration processes.

Steps forward the future unified system • A work on the further development of both the Cadastre and Land Register is in progress: • The improvements in the State Unified Computerised Land Register to develop structured data fields for the further merge of both systems and to digitize the archives (documents); • The improvements in Cadastre IS – the development of the of modular geospatial data system cadastre, address, encumbered territory, value zoning and scale 1:500 topographic plans, the architecture and interface of which ensures unified input, storage and processing of geospatial data maintained by SLS, their link to textual data and convenient use of these data by SLS customers and data exchange partners in the form of e-services and information services, as required by INSPIRE directive.

To improve the cooperation between the SLS and LR, we plan to ensure the direct flow of data: • Cadastre to State Unified Computerised Land Register to update information on addresses, cadastre numbers. Steps forward the future unified system Cadastre to Land Register judges for decision making in case of: land parceling; construction of new building; building demolition. If the changes take place within one property and the separation of property is not requested.
