DO IT: Use your knowledge of American History and Government and the quotation below to answer the following question: “Life and liberty can be as much endangered from illegal methods used to convict those thought to be criminals as from the actual criminals themselves.” - Chief Justice Earl Warren Based on the quote, how can life and liberty be endangered?

  3. Aim: How did the Supreme Court expand the rights of individuals?

  4. Fifth Amendment No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

  5. Sixth Amendment In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

  6. Landmark Warren Court Decisions • Mapp v. Ohio(1961) - Illegal Searches/ evidence seized illegally can not be used in a trial • Gideon v. Wainwright (1963) -Due Process/ Courts must provide a lawyer for the accused for trial. • Escobedo v. Illinois (1964)- Due Process/ The accused has the right to a lawyer at the time of questioning. • Miranda v. Arizona (1966) - Due Process/ The accused must be told of their rights at the time of questioning.

Due Process: Steps from arrest to conviction which protect the rights of the accused. “Innocent until proven guilty” • Arrest: • ‘Reasonable’ suspicion • Search warrant • Miranda Rights • Questioning Suspect: • Waive (give up) Miranda Rights • If suspects asks for a lawyer - • questioning must stop. • Trial: • Suspect must have attorney • Participate in defense • Fair Trial • Appeal Process • Right to appeal decision • RETRIAL if ANY step in Due Process is violated
