  1. 一、提單發貨人(shipper)之規定 實務通常為受益人(出口商),或依據信用狀規定. 信用狀未規定,則依據UCP600第14條k項之規定,任何單據所敘明之貨物發貨人或託運人,無須為信用狀受益人. 1

  2. 二、ISBP有關受貨人之解釋(1) 倘信用狀要求提單顯示貨物係交付予指名之一方,例如：”consigned to Bank X”(直接交付”a ‘straight’ consignment”),而非”to order”或”to order of Bank X”,則提單上於該被指明者名稱前不得含有諸如”to order”或”to order of”之文字,不論其為打字或預先印定 2

  3. 二、ISBP有關受貨人之解釋(2) 信用狀要求貨物之交付係”to order”或”to order of”一指名者,則提單不得顯示貨物係直接交付予指名者 (註:即” consigned to XXX”) 3

  4. 二、ISBP有關受貨人之解釋(3) 倘一提單簽發為憑指示(to order)或憑託運人之指示(to order of the shipper),則須經託運人背書;一背書表明係代替或代表託運人作成者是被接受的 4

  5. 結論：提單受貨人(consignee)之記載 轉讓式:to the order of to the order of shipper (前述兩者,須由發貨人空白背書) to the order of OO Bank to the order of XX Co., Ltd. 直接式: to OO Bank to XX Co., Ltd. 5
