This Week’s Prospecting Activity The focus of this week’s Small Group Meetings is: • Calling the Neighbors • Company-sponsored Just Sold cards are automatically sent out to the neighbors after a home sells. • The cards are a good starting point for a follow-up call to homeowners in that neighborhood. • You can share sold data, tell them about buyers interested in their area and find out if they are thinking of selling.

  25. Policy Update NEW! Electronic Signature Policy & Procedure

  26. Using Electronic Signatures • The federal government enacted the Electronic Signature in Global and National Commerce Act (ESIGN) in 2000. • Most states have enacted laws similar to the model Uniform Electronic Transactions Act (UETA) to permit electronic signatures to be used in real estate transactions, subject to certain conditions applicable in each state. • Generally, electronic signatures can be used as long as the parties agree to conduct business electronically and intend to sign transaction paperwork electronically.

  27. Electronic Signatures at Weichert Weichert’s preferred electronic signature provider, DocuSign, complies with all UETA and ESIGN regulations and is, therefore, acceptable to use.

  28. Limitations to Electronic Signatures • Although electronic signatures are legally binding for real estate transactions, some lenders do not accept electronic signatures on third-party documents (such as sales contracts) unless they can actually validate the borrower’s signature (both identity and authorization). • Some electronic signature providers, such as DocuSign, do have provisions for signature identity verification, but these are often more costly and complicated. • However, if the clients re-sign the documents with an actual signature on or before closing, lenders will accept the paperwork.

Electronic Signature Policy & Procedure To ensure a smooth closing and to protect your clients, a new electronic signature policy is now in effect: For sales transactions, have your buyers sign over any documents signed electronically with an ink or ‘wet signature’ at or before the closing. Keep a copy of the DocuSign security certificate in your records. The certificate can be obtained from your completed envelope by selecting ‘More Options,’ then ‘View Certificate.’ For sales contracts, all digital or electronic signatures that are not verifiable by WFS will require ‘wet signatures,’including the seller’s.

  42. Here’s How It Works! • An e-mail will automatically be sent to you for card review/approval. Please review your card carefully as it will be mailed out exactly as it appears on the PDF. • Revisions to the property information (property photo, address, price) can be made. • Fifty (50) company-paid Just Sold cards will be sent out on your behalf. You must take action, otherwise the cards will not be sent.

  43. More Information • Your order is active for 30 days. Re-orders are available and can be placed during that time. • Cards will be sent within a close radius of the sold property. • You can choose to increase card quantity. Any orders over 50 cards will be billed to your credit card. Please Note: This is not an iMail program (Quantum).

Instructions for “Team” Cards • Before a Just Sold e-mail is generated and sent to you, you will want to have your account set up as a “team.” • For assistance on setting up your “team” account, e-mail support@weichertdesigncenter.com. Please provide an e-mail address for you and your partner (from your WeichertOne profiles) or Associate IDs.

  46. What Happens Next? • From the card, the recipient scans the QR code or enters the URL address and unique code number that directs them to a custom web page with your contact information. • They will be prompted to complete a web form. • Leads go directly to you at the e-mail address you provided in your profile on WeichertOne. • There are no referral fees of any kind!

Eligible Transactions You will receive Just Sold cards through the program for the following types of transactions: • When you sell your own listing or another Weichert listing. • When you sell a Brand X listing. • Please Note: For sales of a Brand X listing, we are prohibited from using images and data from the MLS to generate automated Just Sold cards. This is due to MLS guidelines and restrictions. As a result, for this transaction type you will need to upload your own photo and property address information to complete the order process.

  48. How to Enroll • You are automatically enrolled if you have set up your WeichertOne profile and included a valid e-mail address. • If you need to set up your WeichertOne profile, log on to www.WeichertOne.com and click on “Profile” next to the image in the upper right hand corner.
