Giving Members a Regional Dispute Resolution Option

This recommendation by OIOIO aims to improve ASEAN's international influence by giving members a regional dispute resolution option. The proposal suggests creating a Permanent Dispute Resolution Body to increase effectiveness and flexibility. Currently, the ad hoc Dispute Resolution Panel is underutilized due to its ineffectiveness. The proposal seeks to address overlapping membership issues and provide states with the ability to set regional precedents in dispute resolution. By establishing a permanent body, ASEAN can enhance its influence on the international stage.

  2. Objectives • Increase international influence of ASEAN • Give ASEAN members ability to set only a regional precedent in dispute resolution

  3. Ad hoc Dispute Resolution Panel Dispute Panel picked at Meeting of Senior Economic Officials • Result: Almost no use of ASEAN DR mechanism Current ASEAN DR Mechanism • Flexible, but Ineffective Bilateral DR, mediation, etc.

  4. Dispute • In cases of overlapping membership, states may prefer to set only regional precedent. State Preference in DR • Dispute resolution in an International Organization sets precedent for future dispute resolution in that IO
