Conclusion • Major jurisdictions now mainly effects-based • Most likely to • Protect competition effectively • Maximise consumer welfare • But less predictable than form-based • Need some more certainty through • Safe harbours and block exemptions • Presumptions • Guidance and case precedents • Need greater consistency between jurisdictions
