  1. Subrecipient/ Service Provider Checklist March 2001

  2. REMEMBER: • A preponderance of “true” answers indicates that the organization is a service provider (vendor by federal definition), otherwise the provider (contractee) is a subrecipient. • The substance of the relationship between the parties to the contract is more important than the form of the contract agreement in determining subrecipient or service provider.

  3. #1 True or False The organization provides services to clients whose eligibility for participation in the program is determined by DHS personnel.

  4. Explanation: Determination of client eligibility for DHS funded programs by the contracting entity is one factor contributing to the classification of a provider as a subrecipient by DHS. When DHS determines client eligibility for DHS funded programs provided by a contractor, this favors the classification of the contractor as a service provider. The source of the eligibility criteria is not relevant, only which entity (contractor of DHS) actually decides client eligibility.

  5. #2 True or False This organization provides services for a program of DHS rather than for it’s own program. (DHS is responsible for developing the program and programmatic decisions.) Explanation: Both DHS and the provider could be involved in program development and decision making.

  6. #3 True or False DHS (not this organization) measures the organization’s performance against meeting the objectives of the program. Explanation: Both DHS and the provider could be involved in measuring performance against the objectives.

  7. #4 True or False DHS (not this organization) only has the responsibility for applicable program compliance requirements. Explanation: This one is always false due to contract specifications on compliance.

  8. #5 True or False This organization does not provide matching funds and is not required to share in the cost of the program. Explanation: The contract should stipulate the matching requirements.

  9. #6 True or False This organization provides goods and services within the normal course of its business operation. Explanation: The organizations business would operate even without DHS funding.

  10. This organization provides similar goods and services to different purchasers besides DHS. #7 True or False Explanation:Other clients besides DHS could be served by the organization.

  11. #8 True or False This organization operates in a competitive environment (as compared to a sole source situation). Explanation: Other entities in the general locality could compete for the DHS contract.

  12. #9 True or False The contract can be terminated for the convenience of the awarding agency (DHS) for no cause. Explanation: This one is always true due to contract specifications.

  13. #10 True or False This organization assumes most of the risk for performance on the contract with DHS. Explanation:This one is always true (but could pertain to both the provider and DHS).

  14. #11 True or False The contract is awarded based on free and open competition. (Bid of RFP submittals). Explanation: This means that one provider may obtain the contract over another provider.

  15. #12 True or False This organization retains title to the property purchased with contract funds. Explanation: This is generally true except for special contract provisions.

  16. #13 True or False The services provided by this organization are occasional as compared to ongoing. Explanation: This one is always false (pertains to a continuous service being available, not how often the services are used),
