The need - access to specialist expertise Background • MDI equipment is a highly specialized field in a rapidly evolving market • Bank and Borrowers often do not have appropriate specialist technical knowledge in-house Procurement support • This specialist expertise is critical when procuring MDI equipment and services, especially: • needs identification and project design • procurement approach and evaluation methodology • evaluation of proposals • contract implementation
Expert Panel Bank established an Expert Panel • Bank’s Corporate Procurement Framework Agreements • Opportunity was openly advertised • Framework Agreements awarded to 3 consulting firms and one individual consultant • Expert Panel operational December 2018
Role and impartiality Role of Expert Panel • As industry experts, to provide: • impartial, unbiased advice and feedback on the procurement of MDI equipment and services • on an as-needs basis Impartiality • Bank sought feedback from the industry and suppliers on the independence of shortlisted consultants • Bank needed to know if there was any conflict of interest in providing impartial advice to buyers • No conflicts were identified
Conditions of the Framework Agreements Conditions • Experts can be used in Bank Investment Project Financing (IPF) funded procurements • Framework Agreements awarded for an initial term of 3 years: • option (at the Bank’s discretion) to extend by a further 1 + 1 years • Framework Agreements stipulate the agreed daily fee rates for each consultant: • consultant cannot charge more than the agreed rates, but can offer reduced rates in a closed competitive selection Scope • May provide either project design support or project implementation support, but not both in relation to the same project • Consultant to assist in knowledge transfer and capability building
Contracting a consultant Terms of Reference • Country, project name and description of MDI equipment/services • Scope of the consulting services - clear stipulation of the requirements including the type of advice or support to be sought • Timeframe and deadline for deliverables Award criteria • Award based on optimum combination of quality and cost • Use of rated criteria - price and non-price attributes • Pricing model: • time and materials; or • fixed price / one lump-sum
Bank contracting process • Framework Agreement call-off contract through either: • Consulting Services Contract, Purchase Order (consulting firm) • Short-Term Consulting contract (individual consultant) • Selection based on closed mini-competition • In emergency, or exceptionally urgent situations - direct selection
Borrower contracting process • Borrowers are not parties to the Framework Agreements • Borrower may “leverage” the Framework Agreement, meaning: • consultants appointed to the Expert Panel agree to offer their services to Borrowers on the same terms and conditions, and • at the agreed daily fee rates • Borrower uses its national procurement processes to award contracts
