ESB 5041 - Increasing state contracts with veteran-owned businesses Changes to Existing Laws (SB 5041 defines procurements as the purchase, lease, or rental of any goods or services.) • Purchasing Goals for Public Entities - State and local agencies are encouraged to award 3% of all procurements and contracts that are exempt from competitive bidding requirements to Veteran and Servicemember Owned Businesses. • Architectural & Engineering Services - State and local agencies must provide Veteran and Servicemember Owned Businesses with the maximum practicable opportunity to compete for and receive public contracts.

ESB 5041 - Increasing state contracts with veteran-owned businesses Changes to Existing Laws, continued • State Highway Construction - The Department of Transportation will adopt rules for bids and awards of contracts related to the construction or maintenance of a state highway that do not exceed $100,000, to enable a larger number of Veteran and Servicemember Owned Businesses to effectively compete for the contract. • WDVA Veteran and Servicemember Owned Business Registry - WDVA must ‘certify’ all businesses in the online registry. Previously businesses were asked to self-certify as they registered online.

SB 5557 2011 Senate Bill to Create the Office of Civil Rights (OCR) OMWBE becomes part of new Office of Civil Rights with Human Rights Commission and ethnic commissions • Moves Veteran Owned Business certification, reporting, and Veteran Linked Deposit Program to new OCR • Veteran Owned Business certification program remains the same: • No application fees • No change in Criteria

Outreach & Tracking • OMWBE & WDVA are ready to assist in your outreach to Women, Minority and Veteran Owned Businesses • WDVA will partner with OMWBE to track state agency/higher educational institution purchases from Veteran Owned Businesses in the same way that they are tracked for Minority & Women Business Enterprises now. • WDVA is working with OFM to create an interface with AFRS to capture all payments to Veteran Owned Businesses for state agencies/higher education. This process will be identical to the current OMWBE process.
