  5. What does the SIU do? coordinates and conducts inspections of equipment that have been determined to have a high risk potential if not installed, maintained and operated safely. We are the “Public Safety” side of DLLR.

  6. Inspections Reduce the Risk... of injury by identifying hazards, failures and inadequate installation and maintenance of equipment at the time of inspection and hopefully before public exposure. “protection through inspection”

  12. When: 1) installed in a privately owned single-family residential dwelling; or 2) installed in a building or structure under federal control or regulation.

  13. What’s an elevator unit? • Passenger and freight elevators • Special purpose elevators • Escalators and moving walks • Dumbwaiters • Vertical and inclined platform lifts • Stairway chair lifts

  14. Major Change ELEVATORS The owner of the elevator unit must hire an Authorized Third Party Qualified Elevator Inspector (TPQEI) to perform the required safety inspection. State inspectors will no longer perform periodic annual safety inspections.

SIU will continue…. • Final Inspections on new elevators • Perform inspections on altered elevator units • Investigate accidents and complaints • Follow-up inspections to confirm corrective action • Comprehensive 5-year inspection of elevator units • Periodic annual inspection of publicly owned elevator units • Quality control monitoring of inspections performed by TPQEI.

  16. Building Owner Responsibilities • Re-registration of equipment • Annually • 30 days before periodic inspection • Contract with a TPQEI • Perform inspection on or before due date • Submit inspection report to Commissioner DLLR will notify owner 90 days in advance of the periodic inspection.

  17. Building Owner Responsibilities Must contract with an authorized TPQEI to perform the required periodic annual inspections. A listing of authorized TPQEI can be found on the DLLR web site. www.dllr.state.md.us/ The elevator maintenance company is not authorized to perform the required periodic annual safety inspections.

  18. Building Owner Responsibilities • Ensure that: • Inspections are performed on or before the inspection due date • Any identified violations are abated • You receive a Certificate of Inspection and... • Post the Certificate in or on the equipment.

Building Owner Responsibilities • Maintain their elevator units in accordance with the applicable safety code. • Ensure that all required tests, inspections, repairs and maintenance are performed by qualified persons. • All required test, repair and maintenance documentation are to be kept on the premises and available to State and authorized inspectors.

  20. Building Owner Responsibilities • Operating a elevator in Maryland without a valid Certificate of Inspection is a violation of the law and subject to penalty.

Authorized Inspectors • All TPQEI must register and be authorized by the Commissioner. • Every authorized inspector will be issued credentials identifying them as an “Authorized TPQEI ”. • TPQEI authorization must be renewed annually. Inspectors must maintain their professional credentials and liability insurance. It is the responsibility of the inspector to ensure their authorization remains valid. • Inspection reports received from a TPQEI with an invalid authorization will be rejected which may result in the owner being in violation and subject to penalty.

  22. TPQEI Authorization ID TPQEI - Level 1 Must be an independent elevator consultant, employed by an independent inspection agency or employed by the insurer of the elevator unit; and

  23. Owner and User Responsibilities A listing of Authorized Third Party Inspectors can be found on the Safety Inspection Unit’s web site. http://www.dllr.maryland.gov/labor/safety/ Only Authorized Third Party Inspectorscan perform the required periodic safety inspections.

  24. The Process 1. About 90 days before your inspection due date, you will receive a reminder notice from the State. Included will be a re-registration form. At least 30 days before the inspection due date, complete and return the re-registration form

  25. The Process 2. Contract with your TPQEI to perform the required annual periodic inspection. 3. Perform the inspection on or before the due date. 4. Submit the inspection report to the Commissioner within 30 days of performing the inspection. 5. If necessary, perform a follow-up inspection to verify compliance for each violation noted. 6. Submit the follow-up inspection report to the Commissioner within 30 days of the inspection.

  26. The Process 7. Expect to receive your Certificate of Inspection within 14 days after a satisfactory annual periodic inspection report is received.

  27. The Process • If an inspection report is not received within 45 days after the due date, SIU may send a PAST DUE NOTICE. • If an inspection report is not received within 60 days after the due date, SIU may issue a CITATION with PENALTY.

  31. The Boiler & Pressure Vessel Safety Law applies to all pressure retaining objects operating in Marylandunless specifically exempt.

  32. Major Change October 1, 2010 If a BPV is not insured, then the owner or user must hire an Authorized Inspection Agency (AIA) to perform the required safety inspection. Note: If BPV is insured, the insurer must perform the required inspection. State inspectors will no longer perform periodic safety inspections (“certificate inspections”).

  35. Authorized Inspection Agencies • Insurer AIAs SHALL: • Perform periodic safety inspections of INSURED objects. • Non-Insurer AIAs MAY: • Perform periodic safety inspections of NON-INSURED objects.

Owner and User Responsibilities • Registration of equipment • Annually • 30 days before periodic inspection (verifying location data) • Perform Inspections on or before due date • Insurer performs inspection or; • Contract with non-insurer AIA to perform inspection DLLR will notify owner 90 days in advance of the periodic inspection.

Owner and User Responsibilities • Maintain their boiler and pressure vessel in accordance with the applicable laws, regulations and safety codes. • Ensure that all required tests, inspections, repairs and maintenance are performed by qualified persons. • All required test, repair and maintenance documentation are to be kept on the premises and available to State and authorized inspectors. • Comply with Stationary Engineer Law

  45. The Process • After a satisfactory inspection report is received, your Certificate will be mailed within 14 days. • The Certificate of Inspection must be posted in accordance with the law.

BPV Stakeholders • Installers: • Shall notify State in writing at least 30 days prior to installation (see Notice of Installation) • Shall coordinate with AIA to ensure compliance with Law & Regulations • For boilers, shall submit CSD-1 form CG-500 • CSD-1 is mandatory at time of installation (or discovery) • CSD-1 applies to ALL boilers unless excluded • BPV may be tested, but SHALL NOT be operated without a Certificate of Inspection. • NOTE: Maryland Boiler Law and Regulations do NOT recognize International Mechanical Code.

  48. BPV Stakeholders • Repair Organizations shall: • Maintain a National Board (NB) R Stamp • Give prior notice and receive approval • Repair in accordance with NB R Stamp rules • Submit R Forms to • State • NB • Owner/User
