  2. American Citizenship Citizen – owes allegiance to the United States. 14th Amendment defines citizenship (born or naturalized). Citizenship By Birth– Jus Soli – law of the soil; where one is born 50 States, U.S. Territories, Embassies, etc. Jus Sanguinis – law of blood; to whom one is born Born of at least one parent who is a citizen and has lives in the U.S.

  3. American Citizenship Citizenship By Naturalization – Legal process to allow aliens to become citizens; conducted through the courts. Exclusive power of Congress. Investigated by the Justice Department and INS and approved by a judge. Collective Naturalization – en masse; naturalized by treaty or joint resolution

  4. American Citizenship Expatriation – Legal process involving loss of citizenship. Not automatic Can be involuntary by court order in cases of fraud or deception – Denaturalization. Cannot be gained or lost through marriage although process can be shortened.

  5. American Citizenship Regulation – exclusive (inherent) power of Congress Most regulation began “new” immigrants arriving from southern and eastern Europe and from Asia. Chinese Exclusion Act 1882 “Undesirables” Quantitative – numerical limits Qualitative – character limits Immigration Acts – 1921 &1924 - quotas National Origins Act – 1929 - quotas Immigration and Nationality Act – 1952 - quotas Immigration Act of 1965 – eliminate quotas

American Citizenship Regulation – Immigration Act of 1990 – family preference/skills “Excludable aliens” Nonimmigrants – temporary stays/visas Deportation – legal process where aliens are required to leave. Unlimited power to deport and/or exclude Inherent power Does not require a criminal trial Ex: illegal entry, crimes

American Citizenship Undocumented Aliens – Illegal immigration has become a major problem Undermining labor standards Burdening schools and the public welfare system In 1986, Congress granted amnesty to a large number of undocumented aliens and began punishing employers for knowingly hiring illegal aliens. Illegal Immigration Restrictions Act 1996 – easier deportation process, tougher penalties for smuggling aliens into the country, prevention from claiming Social Security and public housing, expanded the size of the Border Patrol.
