Discipline – Missed Scans • Discipline Letter. • Missed Scan Report for unit for date of charged failure/falsification. • Supervisor’s written report/explanation for all missed scans on above report. • Printout of MSP locations/scheduled times for route involved. • Printout of MSP actual times for date/route involved.

Discipline – Missed Scans • Printout of MSP actual times for date involved/other routes appearing on Missed Scan Report. • Statement of grievant concerning the MSP and the date in question. • Statements of other carriers regarding malfunctioning scanners, scanner report errors, disparate treatment, etc… • Statement (or Steward’s Interview notes) of supervisor regarding malfunctioning scanners’ reports errors, disparate treatment, etc… • Grievant’s training records.

  6. The parties agree that managementwill determine the number of scans on a city delivery route…

  7. MSP does not set performance standards, either in the office or on the street.

  8. MSP data may not constitute the sole basis for disciplinary action…

  9. However it may be used by the parties in conjunction with other records to support or refutedisciplinary action…

  10. Section 432.33 of the ELM remains in full force… “Except in emergency situations, or where service conditions preclude compliance, no employee may be required to work more than 6 continuous hours without a meal or rest period of at least ½ hour.”

  11. Notwithstanding this, the parties agree that city letter carriers will scan MSP scan points as the reach them during the course of their assigned duties.

  16. Scans Clerks & Mailhandlers sort & distribute mail… Clerks scheme training allows them to be 95% accurate to pass… We correct their errors while casing their mis-throws !!!! We sometimes receive the same MIS-SORTED letter Again & Again… Mailhandlers are not scheme trained but move parcels, sacks, direct mail bundles and other size pieces of mail that we deliver. We are their last employee to check for theirerrors. We find those errors daily… Management accepts those errors daily….

Scans • Handbook M-5 Schemes – construction, assignment, training & proficiency: • Section 434.1: • Employees assigned schemes will be provided one try on that first workday following completion of the allotted training time to pass 3 qualification test by correctly sorting 95% or more of the cards in a 100 card test deck… In eight minutes or less. • Employees bidding for scheme assignments will be provided one try to pass a qualification test at the end of the deferment period. • Such an employee may request and be permitted to attempt to qualify no more than two timesprior to the end of the deferment period

  22. Scans Before we get Geeky – lets look at some Proven, Common Sense Issues that we know or experience daily!!!

  23. Scans • Lie Detector (Polygraph) Tests. • Inadmissible as evidence in a court of law because of “unreliability” • 1988 Supreme Court case, United States v. Scheffer • This same unreliabilityexists in our scanners!!!!

  24. Scans Do your Cell Phones fail????? You have to shut them down and restart them Did you ever drop a call???

  25. Scans Have you attempted to access the internet and the page failed??? Did you ever open a WEB Page and images & content are missing … You click reload or refresh and most times the page will be viewed as designed.

  26. Scans This is due to “PACKET LOSS” Heavy data traffic is a primary cause for packet loss The more “users” on a network connection, the greater the chance for “Packet Collisions” and “Packet Loss”.

Scans • Technical Facts (Possible Defenses): • USPS scanners themselves have the same characteristics and problems as all hand held devices. • They are dependent on: • Flash memory, • Hard drives, • Batteries, • Chipsets, • Firmware and more, • All of which are affected by time and age. Every day that passes degrades their reliability.

  28. Scans Did you ever have the Scanner shut down after SCANNING mail??? Would the Scanner POWER-UP???

MSP Scans • The scanner manufacturer themselves will not guarantee 100% reliability in perfect testing conditions. • Yet a front line supervisor has the technical expertise to gauge that it is the carrier at fault when a delivery confirmation is missing on a report!!!!! • Supervisors are not trained or qualified to inspect or certify the operating condition of any scanner, • If it powers on it’s good to go!!!!!!!!!

  30. Intelligent Mail Device (Scanners) • FACT: • THE USPS ACCEPTED THE SCANNERS YOU USE WITH A 95% ACCURACY RATE.

MSP Scans • USPS uses NetBEUI (Pronounced net-booey) to “Transport Data”. • NetBEUI is short for NetBIOSExtended User Interface. • NetBEUI is the oldest government Interface Protocol. • Support for NetBEUI was discontinued when Microsoft developed Windows XP. • That’s why the USPS continues to use “Windows 98”. • There are now seven (7) different Windows Operating Systems. • The business world adopted the newer versions with few exceptions, the U. S. Postal Service is one of the exceptions.

MSP Scans • Carriers return the scanners to the cradles at close intervals. • Among other technical issues this causes – the most frequent problem is a “DATA BOTTLENECK”. • This causes “Packet Collisions”!!! • The “Packet Collisions” can destroy the scanned data and render it unrecoverable in some circumstances.

MSP Scans • Supervisors or Postmasters lack the technical knowledge and “certainty” to charge anyone with “failure to scan”. • They are not basing this discipline on FACT. • Make management “prove” the violation. • Carriers are their own enemy when they “waffle” during questioning about ‘Missed Scans”.
