US Section 508 is in process of “refresh” • Applies to US federal agencies requiring agencies to develop, procure, maintain, and use ICT that best meet its criteria. • Current Section 508 criteria was written in 1998. • Stakeholder committee, including representatives from Canada, Japan, Australia, and European Commission, (TEITAC) formed in Sep 2006 to propose a “refresh”. Report submitted in Apr 2008 • Initial draft (ANPRM) of refresh by the US Access Board released in March 2010. • Second draft (NPRM) expected in 2011 • Emulated at State government level

Structure of Section 508 Initial draft (ANPRM) • Consider what the ICT product contains instead of category of product • Common functionality • Platforms, applications, and interactive content • Electronic Documents • Synchronized Media Content and Players • Hardware Aspects of ICT • Audio Output from Hardware • Conversation Functionality and Controls • Support Documentation and Support Services

Section 255 • Applies to telecom equipment manufacturers and service providers. • Applies to landline phones, mobile phones, and interconnected VOIP traditional telecom functionalities. • Section 255 is required if readily achievable. • FCC is responsible for Section 255. Access Board draft (Section 508 ANPRM) contains Section 255 proposal which is nearly identical to the Section 508 from technical perspective. It is up to FCC to consider the proposal.

Americans with Disabilities Act (AdA) • Enacted in 1990 • Title I: Employment • Title II: Public entities • Title III: Public accommodations • Title IV: Telecom (Section 255) • Currently considering whether web is considered public accommodations; • Also considering next generation emergency services (911)

Canada • Common Look and Feel v2.0 • Managed by the Treasury Board • Applies to Canadian government • To be revised in 2011 and 2012 • Expected to be based on WCAG 2.0 • Related court case in appeal process • Accessibility for Ontarians with Disabilities Act • Proposed detail still in comment period • Applies to private and public sectors • Based on WCAG 2.0 • Use phase in approve from level A to AA over time • Different timeline for government organizations vs. private and large vs. small

South Korea, Australia, and New Zealand • South Korea • Anti-Discrimination against and Remedies for Persons With Disabilities Act • Applies to private and public sectors • Implicitly linked to Korean Information and Communication Standards (KICS) OT-10.0003/R1 (Korean version of WCAG 2.0): Modified in levels and one success criterion from WCAG 2.0 • Australia • Applies to government • Phase in WCAG 2.0 from A to AA • Study in PDF accessibility supported • New Zealand • New Zealand Government Web Standards 2.0 • Applies to Government sites • Information or services in webpages or applications must be available without scripts, applets and other programmatic objects. This includes Flash, Silverlight, Java and Javascript.
