  9. Community Planning Group Recommendation On June 5, 2006, the City Heights Community Planning Committee voted 10-6-2 to approve the project with recommendations

  10. Planning Commission Decision • Planning Commission denied project on September 14, 2006, by a vote of 7-0 • Denial based on Planning Commission’s interpretation of Finding 2 • PC expressed concern regarding the building condition, proposed landscaping and proposed improvements. • Applicant appealed decision to City Council

  11. Staff Response • Project as proposed meets all applicable Municipal Code and Map Act regulations • Finding 2 can be made, no intensification of use is proposed. • New condo regulations adopted 6/13/06 are not retroactive to this project • Applicant has agreed to perform additional building and landscape upgrades

  12. Staff Recommendation • Grant the appeal and APPROVE Tentative Map No. 306904 and the waiver of the requirement to underground the existing overhead utilities
